Acceptance of Performance. If this Lease be assigned or if the Premises or any part thereof be sublet or occupied by anybody other than Tenant, Landlord may, after default by Tenant, collect the rent from the assignee, subtenant or occupant and apply the net amount collected to the rent herein reserved retaining the remainder, if any, for the account of Landlord, but no such assignment, subletting, occupancy or collection shall be deemed an acceptance of the assignee, subtenant or occupant as Tenant hereof, or constitute a release of Tenant from further performance by Tenant of the covenants on the part of Tenant herein contained.
Acceptance of Performance. 8.1 Should it be requested by any of the Parties, a protocol on the acceptance of the Performance shall be written down, which shall be signed by both Parties.
Acceptance of Performance. Landlord shall accept performance by a Recognized Mortgagee of any covenant, condition or agreement on Tenant’s part to be performed hereunder with the same force and effect as though performed by Tenant.

It is agreed by the Parties that the acceptance of Contractor’s performance will be made only by an affirmative action of the City Council of the City of Santa Xxxx in session, evidenced by resolution, and upon the filing by the Contractor of a Release of all Claims of every nature on account of work done under this Contract, together with an affidavit that all claims have been paid. Acceptance of Performance. Landlord may accept Rent, additional rent or performance of Tenant’s obligations from any person other than Tenant pending approval or disapproval of an assignment. Neither a delay in the approval or disapproval of such assignment nor such acceptance of Rent or of performance shall constitute a waiver or estoppel of Landlord’s right to exercise its remedies for Tenant’s default.
Acceptance of Performance. (5.1) The acceptance of performance without objection shall be evidenced by the signing in duplicate of a bilateral Record of Handover (“Record of Handover”) by the Parties or their authorized representatives, in accordance with the requirements in the Technical Specification of the ASSIGNOR.

However, if any such obligations are to be in the first instance performed by Borrower and a Default has occurred, Lender need not accept any such performance by Ground Lessee.
