Amendment to the Certificate of Designations. The Company will use its best efforts to file with the Secretary of State of the State of Delaware an amendment to the Certificate of Designations designating the Series D Preferred Stock to increase the number of shares so designated to include a number of shares sufficient the cover the Securities.
Amendment to the Certificate of Designations. The parties agree that Article II of the Certificate of Designations shall be amended, by the filing of an amendment to the Certificate of Designations with the Secretary of State of the State of Delaware, as follows:
Amendment to the Certificate of Designations. The parties hereto hereby agree to amend the rights of the Preferred Stock as set forth in the Amendment to the Certificate of Designations attached as Exhibit B hereto (the “Amendment”).
