Applicability and Definitions. These 8x8 UCaaS/CCaaS Regional Terms (these “Regional Terms”) shall apply solely with respect to Ordered Products provided to a Customer location (as identified by a physical address specified in the Agreement) (each a “Customer Location”) in the US, Australia, or Canada, except to the extent that one or more particular countries or regions are expressly referenced with respect to a provision of these Regional Terms, in which case such provision shall apply solely with respect to Ordered Products, if any, provided to a Customer Location in the referenced country(ies) or region(s)). Capitalized terms used and not defined in these Regional Terms shall have the meanings assigned to them in the 8x8 UCaaS/CCaaS Service Terms into which they are incorporated (the “Terms”).

This Agreement shall apply only to Salaried Employees or Ad Hoc Employees at Grades A to E inclusive by reference to the XXXX Job Evaluation Grades employed by XXXX member companies to work in catering, accommodation and ancillary services on recognised types of offshore installation. A recognised offshore installation is one only of the following - production platforms: drilling installations: floating production storage and offloading vessels: floating production units: floating, storage and unloading units, and accommodation barges, situated in the northern and southern sectors of the United Kingdom sector of the Continental Shelf. Salaried Employees are those who work on a specific recognised offshore installation by a regular rota pattern, or are a part of a permanent relief crew and are paid an annual salary for doing so on the basis set out at Section A below. Ad-hoc Employees are those who are employed to work as and when required by the employer on irregular rotas, which may be on different recognised offshore installations and for different durations and paid a day rate for doing so on the basis set out at Section B below. Reference to “an offshore day” is to a period of time of up to 24 hours which must include an over-night stay offshore. The day of return onshore is not counted as an offshore day. Reference to “the Regulations” is to the Working Time Regulations 1998, as amended. Reference to a “year” is to the period commencing 1st September to 31st August inclusive. Reference to “the unions” is to the RMT and Unite.

Upon delivery the Purchaser shall inspect the goods delivered for any visible defects, ensure that the number of pallets and boxes correspond with the number given in the delivery notes and that the quantities delivered correspond with the quantities given on the boxes and acknowledge receipt of the Products on the carrier’s delivery note. In these General Terms and Conditions, Product(s) shall mean the Supplier’s current product range available on the Suppliers webpage xxx.xxxxxxxx.xxx and all other products offered by the Supplier or all products which the Supplier undertakes to supply, which the Supplier undertakes to sell to the Purchaser, and which are set forth in detail in an Agreement. In these General Terms and Conditions, Service(s) shall mean all Services that the Supplier undertakes to perform towards the Purchaser in connection with the Product.
