Availability of Space. Upon submission of an Application, BellSouth will permit ALEC Inc., to physically collocate, pursuant to the terms of this Attachment, at any BellSouth Remote Site Location, unless BellSouth has determined that there is no space available due to space limitations or that Remote Site Collocation is not practical for technical reasons. In the event space is not immediately available at a Remote Site Location, BellSouth reserves the right to make additional space available, in which case the conditions in Section 7 shall apply, or BellSouth may elect to deny space in accordance with this section in which case virtual or adjacent collocation options may be available. If the amount of space requested is not available, BellSouth will notify ALEC Inc., of the amount that is available.
Availability of Space. With regard to the relocation of the --------------------- Facilities, space on the Tower must be available at the levels, and/or space on the ground must be available at the locations, to which User desires to relocate and, if consent of the Master Landlord is required to relocate the Ground Facilities, then such consent must be obtained prior to relocation.
Availability of Space. The use of the bike racks are on a first come first service basis and no guarantee is provided by the Licensor that space will be available in the bike racks when required by the Licensee.

BellSouth will respond to an application within ten (10) business days as to whether space is available or not available within a BellSouth central office premises.

Upon submission of an application, BellSouth will permit TelCove to physically collocate in any available full bay/rack of space, pursuant to the terms of this Attachment, at any BellSouth Remote Site Location, unless BellSouth has determined that there is no full bay/rack of space available due to space limitations after BellSouth has conducted a review of all space within the Remote Site Location or that collocation at the Remote Site Location is not practical for technical reasons. In the event space is not immediately available at a Remote Site Location, BellSouth reserves the right to make additional space available, in which case the conditions in Section 7 below shall apply, or BellSouth may elect to deny space in accordance with this Section in which case virtual or adjacent collocation options may be available. If the amount of space requested is not available, BellSouth will notify TelCove of the amount that is available.
Availability of Space. BellSouth will permit ALEC, Inc. to physically collocate, pursuant to the terms of this Agreement, at any BellSouth Premises, unless BellSouth has determined that there is no space available due to space limitations or due to technical infeasibility. Such determinations shall be subject to the following condition: after notifying ALEC, Inc. that BellSouth has no available space in a particular Premises, BellSouth must timely file a petition with the Commission pursuant to 47 U.S.C. § 251(c)(6). BellSouth will maintain a waiting list of customers on a first come, first served basis. BellSouth will notify the telecommunications carriers on the waiting list when space becomes available according to how much space becomes available and the position of telecommunications carrier on said waiting list. BellSouth will post a Carrier Notification letter on BellSouth’s Interconnection website as a general notice that space in a Premises has become available. Upon request BellSouth will advise ALEC, Inc. as to its position on the list. Notwithstanding the foregoing, should any state regulatory agency impose a different procedure regarding the assignment of space in a central office where space has been previously unavailable, that procedure shall supersede the requirements set forth herein.
Availability of Space for Collocation at the Premises Space is presumptively available at all wire centers, including the two where the Arbitrator found space was not available, but ATU may, if it wishes, demonstrate that space is not available at the two (Central and X’Xxxxxx). [NOTE: If AT&T Alascom requests space, ATU is free to demonstrate that space is unavailable at any center.]
