Construction and Defined Terms. Unless otherwise expressly stated in this Agreement, capitalized terms used in this Agreement shall have the following meanings:

Construction and Defined Terms. Construction of the language of this Agreement shall be as set forth in Exhibit A. Capitalized terms used in this Agreement (including Exhibits and Schedules hereto) but not defined in the body hereof shall have the meanings ascribed to them in Exhibit A.
Construction and Defined Terms. The Original Purchase Agreement and this First Amendment shall constitute and be construed as a single instrument. Accordingly, (i) any term in this First Amendment (capitalized or not) that is specifically defined in the Original Purchase Agreement shall—unless such term shall be specifically defined in this First Amendment—have the definition given to it in the Original Purchase Agreement, and (ii) if any provision in this First Amendment shall conflict with or contradict any provision in the Original Purchase Agreement, then the provision in this First Amendment shall control the interpretation of such Original Purchase Agreement and this First Amendment together as a single instrument.
