Controlling Authorities. This Agreement is made with the understanding that its provisions are controlled by the Cable Act, other federal laws, state laws, and all applicable local laws, ordinances, and regulations. To the extent such local laws, ordinances, or regulations clearly conflict with the terms and conditions of this Agreement, the terms and conditions of this Agreement shall prevail, except where such conflict arises from the Franchising Authority’s lawful exercise of its police powers.
Controlling Authorities. 27.3.1. The Controlling Authority for each Party is the person identified as such in Schedule A. A Party may, by written notice to the Controlling Authority of the other Party, from time to time change its Controlling Authority, and the Parties shall amend Schedule A accordingly.
Controlling Authorities. Except as set forth in the Section of Part II of this Schedule captioned “Limited Waiver,” Licensee’s obligations related to its performance of servicing (and related charges) and repurchase are as set forth in the Mortgage Selling and Servicing Contract, the Xxxxxx Xxx Guides and this Agreement. Use of the Licensed Application by Licensee or Xxxxxx Xxx in no way limits, alters or revises such obligations, including performance of servicing in compliance with applicable laws and other requirements, which are controlling regardless of (i) the accuracy or completeness of any information Licensee submits to or obtains from the Licensed Application and (ii) Licensee’s use of or reliance upon it.
Controlling Authorities. In administering all matters covered by this Agreement, officials and employees ate governed by existing or future laws and regulations of a higher agency level, including policies set forth in Government-wide regulations, by published Air Force and Air Combat Command (ACC) policies and regulations existence at the time this Agreement is approved by DoD Field Advisory Service and by subsequently published agency policies and regulations of appropriate authorities.
Controlling Authorities. 3.1 This Franchise Agreement is subject to and shall be governed by the Cable Ordinance and any amendments thereto which are lawful and consistent with the City Franchise Authority, and all other Applicable Law. In the event of conflict or ambiguity between this Franchise Ordinance and any amendments thereto, the generally applicable Cable Ordinance and any amendments thereto shall control unless preempted by federal law or regulation
