DAMAGES AND SPECIFIC PERFORMANCE. RECIPIENT agrees that should RECIPIENT breach any of the promises contained in this Agreement that OWNER would suffer irreparable harm and OWNER would be without adequate remedy at law and that OWNER may obtain injunctive relief, including specific performance of the Agreement, as well as monetary award for damages suffered by OWNER for RECIPIENT’S breach of this Agreement.
DAMAGES AND SPECIFIC PERFORMANCE. The Employee expressly recognizes that any breach of the provisions of this Agreement is likely to result in irreparable injury to the Protected Entities and that money damages may not adequately compensate the Protected Entities for such breach. Therefore, the Employee agrees that the Protected Entities shall be entitled, if it so elects, to institute and prosecute proceedings in any court of competent jurisdiction not only to obtain damages for any breach of this Agreement, but also to enforce the specific performance of this Agreement by the Employee and to enjoin Employee from activities in violation of this Agreement
DAMAGES AND SPECIFIC PERFORMANCE. If the default occurs following conveyance of the Property or portion thereof, prosecuting an action for damages or specific performance; and

Upon an Event of Default, the defaulting Party shall be liable to the other Party for any damages caused by such default, except as otherwise expressly provided herein. The non-defaulting Party, at its option, may institute an action for specific performance of the terms of this Agreement.

The Executive expressly recognizes that a breach of certain provisions of this Agreement is likely to result in irreparable injury to the Company and that money damages may not adequately compensate the Company for such breach. Therefore, the Executive agrees that the Company shall be entitled, if it so elects and in addition and supplementary to other rights and remedies existing in its favor, to institute and prosecute proceedings in any court of competent jurisdiction not only to obtain damages for any breach of this Agreement, but also to enforce the specific performance of this Agreement by the Executive, enjoin the Executive from activities in violation of Section 13 or to obtain other equitable relief (without posting a bond or other security).
