Common use of Demands, Notices and Communications Clause in Contracts

Demands, Notices and Communications. All formal demands, notices and communications by and among the Trustee, the Trust Administrator, the Certificate Registrar and the Holder of any Certificate shall be in writing and delivered in person or by first class mail, postage prepaid to the Trustee, the Trust Administrator or the Certificate Registrar, as the case may be, at its address set forth in the Pooling and Servicing Agreement, or to the Holder of any Certificate at its address as shown on the Certificate Register. Any notice so mailed within the time prescribed in this Trust Agreement shall be conclusively presumed to have been duly given whether or not the Person to whom such notice shall have been directed receives such notice.

Any notice so mailed within the time prescribed in this Trust Agreement shall be conclusively presumed to have been duly given whether or not the Person to whom such notice shall have been directed receives such notice.
