Equipment Availability. If Vodafone is unable to provide the Equipment requested, Vodafone will agree with Customer to provide alternative Equipment if practicable to do so.

Subject to RB Group's receipt of full payment and Buyer's completion of any additional, required documents, you and the Buyer will be notified that the Equipment is available for pick-up via an email that is generated automatically by the Marketplace ("Item Release"). You agree to have the Equipment available for transportation, complete with ignition key, if applicable, to the Buyer no later than one business day after a Binding Obligation is created. If the Equipment is not available, you will be subject to pay a Post-Closing Delay Fee. Further, if you fail for any reason to release the Equipment to the Buyer after a Binding Obligation is created, you will be subject to a Seller Default Fee in addition to any other rights or remedies that RB Group or Buyer may have.
Equipment Availability. The Contractor shall provide a web-referenced list of FirstNet capable devices made available to users via the Local Control Tool portal. The list shall specify device manufacturer, model number, device type (i.e. smartphone, USB modem).

Copper Mountain will use reasonable efforts to fill all Purchase Orders within forty-five (45) days of the date such Purchase Orders are accepted by Copper Mountain, subject to Equipment availability from Copper Mountain and its manufacturing sub-contractors and Copper Mountain's production and supply schedules. Should Purchase Orders for Equipment exceed Customer's current Forecast, Copper Mountain will allocate its available inventory and make deliveries on a basis Copper Mountain deems equitable, in its sole discretion, and without liability to Customer on account of the method of allocation chosen or its implementation. However, Copper Mountain shall not be liable to Customer or any third party for any damages due to Copper Mountain's failure to fill any Purchase Order or for any delay in delivery or error in filling any Purchase Order for any reason whatsoever, except to the extent such damages result from the gross negligence or willful misconduct of Copper Mountain.
Equipment Availability. In the event a FSE is at the Buyer site and the equipment is unavailable for servicing which causes a delay in excess of four (4) hours and consequently prevents the timely completion of the Services, Seller, in its sole discretion, may charge Buyer for “waiting time” at the standard hourly rate quoted in the current Seller Services price list.

The District will have sufficient protective equipment to comply with federal, state, and local public health guidance for students and staff appropriate for SCTA unit members. The District agrees to have a plan to ensure the ongoing support of protective equipment and to purchase thermometers or others devices for symptom screenings. The District will closely monitor mask inventories to ensure proper inventories are maintained.
Equipment Availability. The Supplier will make available spare or replacement parts for the Goods for a period of ten years from the final Delivery Date. However, the Supplier may, from time to time phase out certain spare or replacement parts by agreement with the Purchaser. Under such circumstances the Supplier will provide at least twelve months’ notice of its intention to discontinue supply or to provide such notice as is reasonable if such discontinuance is outside its control and will agree with the Purchaser a date for last order placement and supply of the parts affected on terms and prices to be agreed.

Customer agrees to make the instruments covered under the Agreement available for servicing at the time of each scheduled Preventative Maintenance (“PM”) or emergency service call. The Xxxxxxx Xxxxxxx Service Representative will contact Customer to set a mutually agreeable date and time for each service visit.
