Excessive Usage. We shall have the right, including without limitation where we, at our sole discretion, believe that Customer and/or any of its Users, have misused the Service or otherwise use the Service in an excessive manner compared to the anticipated standard use (at our sole discretion), to offer the Subscription in different pricing and/or impose additional restrictions as for the upload, storage, download and use of the Service, including, without limitation, restrictions on Third Party Services, network traffic and bandwidth, size and/or length of content, quality and/or format of content, sources of content, volume of download time, etc.

Excessive Usage. During times of prolonged, excessive usage of the Products and Services, we reserve the right to charge you additional fees not exceeding our estimated incremental costs, including applicable fees and taxes, for such Excess Usage. The term “Excess Usage” shall mean the amount of SMS texting segments and/or phone voice minutes per FTE initiated through the Connect and/or Mass Notification services during a calendar month over 20 such segments or minutes per FTE in any two or more consecutive calendar months above such level. We shall use best commercial efforts to notify you through our client portal, our representatives, and/or via email prior to assessing any such additional charges, which shall not exceed $.0065 per segment or minute. Unless otherwise specified in the Order Form, "FTE" is defined as the number of full-time students plus half of the part-time students enrolled at your institution. Blackboard reserves the right to charge for overages as they occur throughout the term, provided however, any failure by Blackboard to timely invoice for any overages shall not constitute a waiver of your obligation to pay such fees.

Excessive Usage. If any Customers on a specific VoIP Service plan have usage exceeding by ten (10) times the average usage of all the customers on the same VoIP Service plan subscribing to the same number of lines, the Customer may be charged an additional fee of $50.00 per month per line.
Excessive Usage. DE Executive Cyber reserves the right to monitor Customer's bandwidth and/or disk usage and to utilize technology to limit such usage to ordered amounts and/or to charge Customer for any excessive usage. DE Executive Cyber further reserves the right to suspend access to Customer's website, script or other application in the event DE Executive Cyber reasonably believes that such website, script or other application is the cause of interruptions in DE Executive Cyber's ability to provide services to other customers, which suspension or termination shall not relieve Customer of its obligation to pay the fees for the Services. In the event of any such suspension, DE Executive Cyber will notify Customer as soon as practicable so that Customer may take remedial action in order to regain access to its website, script or other application. Customer acknowledges and agrees that in an effort to control spam (i) DE Executive Cyber may utilize certain technologies to block incoming and outgoing email which DE Executive Cyber determines, in its sole discretion, may be spam, (ii) DE Executive Cyber servers will not accept connections from unsecured systems (including, without limitation, open relays, open proxies, open routers or any other system that has been determined to be available for unauthorized use), (iii) DE Executive Cyber may, in its sole discretion, reject connections from systems that use dynamically assigned or residential IP addresses, and (iv) DE Executive Cyber may, in its sole discretion, reject connections from any IP address that does not have reverse DNS (a PTR record).
Excessive Usage. Softbrik provides the Customer with business software at a great value for the price. However, if the Customer consume a lot of Softbrik’s resources beyond the tier of their commercial agreement on the Pricing section of the Softbrik website at Effective Date of consumption of that particular tier of service for the Customer, Softbrik will need to charge a fair additional fee. Softbrik will send out notifications before the customer reach the usage limits but if the Customer believes that they are coming close to the usage limit, they should contact Softbrik at xxxxxxx@xxxxxxxx.xxx to discuss and define a tailor-made solution that suits Customer needs better without disrupting their services or usage experience. These limits apply to all categories of Softbrik customers and are in accordance to the limitations mentioned in the Pricing section of Softbrik website as a part of the package bought by the Customer.
Excessive Usage. Client agrees that use of the hosting services for each Client Website will not require excessive usage of system resources and/or bandwidth to the point that server performance is compromised and affects other sites on the server. Any Client Website utilizing excessive server resources may be suspended or terminated without warning to protect other sites on the server. When possible, advance warning will be provided, however if the excessive usage is deemed to be causing immediate harm to Developer’s server or network, no warning will be provided. Acceptable arrangements must be made (such as removal of the offending script, payment of fees related to overages, or expansion of the dedicated server to provide more bandwidth allowance) prior to the account being reinstated. Repeated excessive usage will result in the account being canceled without the possibility for reinstatement or refund. Developer retains sole discretion over what constitutes excessive usage, repeated excessive usage, and/or acceptable arrangements, but will collaborate with Client in making any final determinations regarding the Client Website in question.

Excessive Usage. If it is determined that Customer’s usage is abusive, Customer agrees to pay a per minute, per text message, or per page fee for use in excess of typical levels at the then current rate established by Lantech Communications, of at least $.039 per minute for voice calls and/or $.06 per facsimile page.
