EXPERT ASSISTANCE. 175 While Broker has considerable general knowledge of the real estate industry and real estate practices, Broker is not an 176 expert in the matters of law, square footage, acreage, home inspections, geological issues, wood destroying organisms, 177 taxation, financing, surveying, structural conditions, hazardous materials, engineering, etc. Client acknowledges 178 Broker’s advice to seek professional assistance and advice as needed in these and other areas of professional expertise. 179 If Broker provides names or sources for such advice or assistance, Broker does not warrant or guarantee the services 180 and/or products obtained by Client. 181 11. Xxxxxx advises Seller to obtain expert assistance with respect to legal, tax and accounting matters or matters relating to zoning, surveying, inspections, construction, hazardous materials, engineering, or other matters that are not within the expertise of Broker. EXPERT ASSISTANCE. The opinions of any Certified Rangeland Manager or other qualified professional engaged to assist the Parties in the resolution of any claim of injury to any Conservation Value shall be admissible in any judicial proceedings conducted with respect to that asserted violation.

EXPERT ASSISTANCE. Arbitration, mediation, deposition, and trial and relatedpreparation. All expert witness depositionfees are due either at the beginning or if agree upon at the deposition, at the end of - no exceptions. Depositions will notproceed without this agreement. ** Reimbursable Expenses include but are not limited to thefollowing: long distance transportation and living expenses in connection with out-oftown travel; long distance communications; photographs and development; mileage; color copies; client request for additional copies; overnight mailings and courier; reproductions, postage, and handling of drawings, specifications and other documents; laboratory tests; renderings, models and mock-ups requested by the Client; change in or additional insurance coverage, limits orprovisions, required by the Client in excess of that normally carried by TRS.

If Broker or licensees associated with Broker provide names or sources to Client for such advice or 201 assistance, those services and / or products are not warranted or guaranteed by the Broker or the Licensees associated 202 with Broker. 203 9. OTHER PROVISIONS. 204 A. Binding Effect, Entire Agreement, Modification, and Assignment. This Agreement shall be for the benefit of, 205 and be binding upon, the parties hereto, their heirs, successors, legal representatives and permitted assigns. This 206 Agreement may only be assigned with the written consent of both parties. This Agreement constitutes the sole and 207 entire agreement between the parties hereto and no modification of this Agreement shall be binding unless signed by 208 all parties or assigns to this Agreement. No representation, promise, or inducement not included in this Agreement 209 shall be binding upon any party hereto. Any assignee shall fulfill all the terms and conditions of this Agreement.
EXPERT ASSISTANCE. Staff representative at the TOTAL EWC may be assisted at preparatory meetings by the (French) “Comité de groupe” accountant, or an expert of their choice, remunerated by the Management, in so far as that is necessary for carrying out their tasks. If appropriate, the expert may attend the plenary meeting, with the Management’s approval.
