Formal Appeals. NAD hears formal appeals on final technical determinations and program decisions (7 CFR Sections 614.8(b)(2) and 614.9(a)(4)). NAD conducts hearings to afford a participant the opportunity to present testimony or documentary evidence or both in order to have a previous determination or decision reversed and demonstrate why an adverse decision was in error. A NAD hearing is held and conducted within the agency’s authority defined at 7 CFR Part 11. (See the NAD Hearing Guide NAD Hearing Officer’s Guide.)

Formal Appeals. In the case of the Disciplinary Appeals, the request for a formal appeal must be made by the employee or union representative, with permission from the employee. For Dispute Appeals, the written request for a formal will also be accepted form a union representative. For either Disciplinary Appeals or Dispute Appeals, the written request must be filed within (10) working days from the date of the Employee Services Director's final written decision. Request for a formal appeal shall be filed with the Employee Services Director.

  • Legal Appeals a. Nothing contained in these provisions is intended to limit or impair the rights of any vendor or Contractor to seek and pursue remedies of law through the judicial process. Appendix C Appendix C, Contract Modification Procedure, attached hereto, is hereby expressly made a part of this Contract as fully as if set forth at length herein. Appendix D Appendix D, Pricing Schedules, attached hereto, is hereby expressly made a part of this Contract as fully as if set forth at length herein. The Parties expressly agree that these prices are established as “maximum Not-To-Exceed prices”. The Contractor acknowledges that any mini-bid under this Centralized Contract which includes pricing in excess of the “maximum Not-To-Exceed price” shall be rejected by the Authorized User. OGS reserves the right to make unilateral changes to this Report of Contract Purchases document. Appendix F Appendix F, Project Based Information Technology Consulting Services Processes and Forms, attached hereto, is hereby expressly made a part of this Contract as fully as if set forth at length herein. OGS reserves the right to change the processes and forms set forth Appendix F in non-material and substantive ways without seeking a contract amendment.   • Final Approval Order and Judgment 68. Plaintiff’s Motion for Preliminary Approval of the Settlement will include a request to the Court for a scheduled date on which the Final Approval Hearing will occur. Plaintiff shall file her Motion for Final Approval of the Settlement, and application for attorneys’ fees, costs, and expenses and for Service Award for the Class Representative, no later than 45 days before the Final Approval Hearing. At the Final Approval Hearing, the Court will hear argument on Plaintiff’s Motion for Final Approval of the Settlement, and on Class Counsel’s application for attorneys’ fees, costs, and expenses, and for the Service Award for the Class Representative. The letter will provide you with information regarding our determination.
