Interest and Late Fees. ADVERTISING PROVIDER shall pay a penalty for late or delinquent payments accruing out of this Agreement, whether Annual License Fee or otherwise, of eighteen percent (18%) per annum or 1 . 5 % p e r m o n t h on the balance of the unpaid amount, calculated from the date the amount was due until the close of the Business Day upon which the delinquent payment was received by CITY.
Interest and Late Fees. In the event Tenant should fail to pay to Landlord any Rent or other charge when due, Tenant shall pay to Landlord (a) interest on the unpaid amount from the due date through the date of payment, in an amount equal to ten percent (10%) per annum; plus (b) a late fee for Landlord’s increased administrative expenses, in an amount equal to one percent (1%), per month, of the amount owed Landlord. Tenant acknowledges that Landlord’s actual damages for late payments and returned checks may be difficult or impractical to fix; and therefore, Tenant further acknowledges that such estimated fees and charges are fair and reasonable liquidated damages.

Such service charge and interest payments shall not be deemed consent by Landlord to late payments, nor a waiver of Landlord’s right to insist upon timely payments at any time, nor a waiver of any remedies to which Landlord is entitled as a result of the late payment of Rent. The exercise of any remedy by Landlord shall not be deemed an election of remedies or preclude Landlord from exercising any other remedies in the future.

  • Interest and Late Charges If Tenant fails to pay when due any Rent or other amounts or charges which Tenant is obligated to pay under the terms of this Lease, the unpaid amounts shall bear interest at the maximum rate then allowed by law. Tenant acknowledges that the late payment of any Monthly Installment of Base Rent will cause Landlord to lose the use of that money and incur costs and expenses not contemplated under this Lease, including without limitation, administrative and collection costs and processing and accounting expenses, the exact amount of which is extremely difficult to ascertain. Therefore, in addition to interest, if any such installment is not received by Landlord within ten (10) days from the date it is due, Tenant shall pay Landlord a late charge equal to ten percent (10%) of such installment. Landlord and Tenant agree that this late charge represents a reasonable estimate of such costs and expenses and is fair compensation to Landlord for the loss suffered from such nonpayment by Tenant. Acceptance of any interest or late charge shall not constitute a waiver of Tenant's default with respect to such nonpayment by Tenant nor prevent Landlord from exercising any other rights or remedies available to Landlord under this Lease.

If any payment of principal of or interest on an Advance shall become due on a day which is not a Business Day, such payment shall be made on the next succeeding Business Day and, in the case of a principal payment, such extension of time shall be included in computing interest in connection with such payment.
