New Bridges. Each new bridge located by the Engineer requires approval from the State District Bridge Inspection Office before an identification number is assigned, the bridge is inspected, or the bridge is added to the inventory. If approval is granted to inspect a new bridge, the Engineer shall create a new folder labeled in the format established by the State, complete all forms, calculations, sketches, and input all necessary data into InspectTech and ensure a complete and accurate record.

New Bridges. In the event that new railroad bridges are to be constructed along the right-of-way occupied by Utility and Utility desires to locate its cable facility on such bridges, provision for Utility cable will be incorporated into the bridge design. Costs of design, construction, and materials attributable solely to Utility's use of the structure, as well as costs of any temporary relocation of Utility's facilities during bridge construction, will be paid by Utility. EXHIBIT H EMERGENCY AND DISASTER RESPONSES In the event of an emergency or disaster which results in actual damage to Facilities or System or to Railroad's facilities or operations, or creates a situation wherein it is reasonably possible that such damage may occur, immediate contact shall be established between Railroad's Operations Center, and applicable division personnel, and Utility's Operation Center and applicable Area Representatives. Detailed procedures effectuating the above notification shall be mutually established. Railroad and Utility will fully cooperate with each other and coordinate their efforts to jointly and severally restore operation of their respective rail and communication systems, with each being solely responsible for all costs incurred in repairing its own facilities. In the event such cooperation results in one party incurring costs that are for the benefit of the other (e.g., Railroad providing railroad equipment to Utility), such costs shall be subsequently fully reimbursed. Utility will maintain emergency material and repair kits at various points throughout its System. Railroad shall have the right to establish priorities for making repairs which impact upon rail operations, but shall permit Utility to move forward in making repairs to Utility's System or Facilities when to do so would not impair rail operations. CSX TRANSPORTATION Specifications for crossings of wires or cables of Telegraph, Telephone, Signal, and other Circuits of Similar character over CSXT Rights of Way, Tracks, or Lines of wires of the same classes.

  • Infrastructure (a) The Borrower has and will maintain a sufficient infrastructure to conduct its business as presently conducted and as contemplated to be conducted following its execution of this Agreement.

  • External Hosting Facilities Transfer Agent shall implement controls, consistent with applicable prevailing industry practices and standards, regarding the collection, use, storage and/or disclosure of Fund Data by an external hosting provider.

  • Amenities Amenities shall be prescribed as provided in Appendix F of this Agreement.

  • Directory To participate in the MnDOT TGB program, a business must be certified at the time of contract execution. Certified Targeted Group Businesses are listed in the Directory of Certified Targeted Group, Economically Disadvantaged and VET Vendors. MnDOT makes no representation as to any TGB’s technical or financial ability to perform the work. Prime contractors are solely responsible for performing due diligence in hiring TGB firms. A TGB’s failure to perform the work will not be considered justification for a compensation increase or time extension.

  • Access to Premises Landlord, its agents, servants, or employees may enter the Premises at reasonable times with reasonable advance notice to Tenant (or an authorized employee of Tenant at the Premises), and at any time, upon reasonable notice to Tenant under the circumstances, in an emergency, to do the following: inspect the Premises; comply with all laws, orders, ordinances and requirements of any governmental unit or authority for which Landlord may be responsible under this Lease, if any; show the Premises to prospective lenders or purchasers and, during the ninety (90) days immediately prior to the expiration of this Lease if Tenant declines to renew for an additional term in accordance with the provisions of this Lease, to prospective tenants, but only if all such showings are accompanied by a representative of Tenant if so requested by Tenant; or post (on the Development, but not within or at the entrance of the Premises) for sale or for lease signs; provided; however, that all such entries shall be completed promptly in a good workmanlike manner so as to cause the least practical interference to Tenant’s business and Tenant’s use of the Premises. In all events, Landlord shall use commercially reasonable efforts to minimize interference with the Premises and Tenant’s business operations thereon. If Landlord’s entry materially and substantially interferes with the conduct of Tenant’s business and/or cause damage to Tenant’s property (and the entry is not needed because of Tenant’s default, negligence or willful misconduct), then in such event the rent and any sums due and payable as additional rents, shall xxxxx in proportion to the extent of the interference and Landlord shall be liable for any damage to Tenant’s property.

  • Hosting 46.7.4.1 At CLEC’s request, SBC-SWBT and SBC-AMERITECH shall perform hosting responsibilities for the provision of billable message data and/or access usage data received from CLEC for distribution to the appropriate billing and/or processing location or for delivery to CLEC of such data via SBC-SWBT’s and SBC-AMERITECH’s internal network or the nationwide CMDS network pursuant to the applicable Appendix HOST, which is/are attached hereto and incorporated herein by reference.

  • Configuration The configuration for the Purchase Right Aircraft will be the Detail Specification for Model 767-3S2F aircraft at the revision level in effect at the time of the Supplemental Agreement. Such Detail Specification will be revised to include (i) changes required to obtain required regulatory certificates and (ii) other changes as mutually agreed upon by Boeing and Customer.
