Preliminary Relief. Any party to the Dispute may seek preliminary relief at any time after negotiation has failed, but prior to arbitration, in accordance with the Optional Rules for Emergency Measures of Protection of the AAA Commercial Arbitration Rules and Mediation Procedures. The AAA case manager may appoint an arbitrator who will hear only the preliminary relief issues without going through the arbitrator selection process described in Article 13.5.1.
Preliminary Relief. At any point after a Dispute has arisen, in the event interim or provisional relief is necessary to protect the rights or property of a party under Section 9 of these Terms of Sale or otherwise prior to the resolution of the Dispute, either party may, without waiving any process or remedy under these Terms of Sale, seek such relief from any court of competent jurisdiction.

Preliminary Relief. A Party is entitled to seek interlocutory relief and/or a preliminary injunction without first following the procedure of this Section 10.1; provided that it also invokes the procedure of this Section 10.1 in parallel. Each Party hereby irrevocably waives its right to jury trial of any and all disputes arising under this Agreement, and consents to have such disputes decided instead by a judge or justice.
Preliminary Relief. Nothing in this Annex A shall preclude either party from seeking provisional or conservatory measures (including, without limitation, preliminary injunctions to prevent breaches of this Agreement) in aid of arbitration from any court of competent jurisdiction. In addition, the arbitral panel may, at the request of a party, order provisions or conservatory measures (including, without limitation, preliminary injunctions to prevent breaches of this Agreement) and, to the extent permitted by applicable laws, the parties shall be able to enforce the terms and provisions of such orders in any court having jurisdiction.

Notwithstanding Section 11.1, a Party may seek and apply for preliminary and/or permanent injunctive relief through the equitable powers of courts in the State of New York at any time to prevent ongoing or threatened harm due to an applicable breach of this Agreement or other good cause.
