Common use of Reference to and Effect on the Credit Agreement and the Loan Documents Clause in Contracts

Reference to and Effect on the Credit Agreement and the Loan Documents. (a) On and after the Amendment No. 3 Effective Date, each reference in the Credit Agreement to “this Agreement”, “hereunder”, “hereof” or words of like import referring to the Credit Agreement, and each reference in the Notes and each of the other Loan Documents to “the Credit Agreement”, “thereunder”, “thereof” or words of like import referring to the Credit Agreement, shall mean and be a reference to the Amended Credit Agreement. This Amendment No. 3 constitutes a “Loan Document” under and for all purposes of the Loan Documents.

Reference to and Effect on the Credit Agreement and the Loan Documents. (a) On and after the Amendment No. 3 2 Effective Date, each reference in the Credit Agreement to “this Agreement”, “hereunder”, “hereof” or words of like import referring to the Credit Agreement, and each reference in the Notes and each of the other Loan Documents to “the Credit Agreement”, “thereunder”, “thereof” or words of like import referring to the Credit Agreement, shall mean and be a reference to the Amended Credit Agreement, as amended by this Second Amendment. This Second Amendment No. 3 constitutes a “Loan Document” under and for all purposes of the Loan Documents.

(a) On and after the Amendment No. 3 4 Effective Date, each reference in the Credit Agreement to “this Agreement”, “hereunder”, “hereof” or words of like import referring to the Credit Agreement, and each reference in the Notes and each of the other Loan Documents to “the Credit Agreement”, “thereunder”, “thereof” or words of like import referring to the Credit Agreement, shall mean and be a reference to the Amended Credit Agreement. This Amendment No. 3 4 constitutes a “Loan Document” under and for all purposes of the Loan Documents.

This Fourth Amendment No. 3 constitutes a “Loan Document” under and for all purposes of the Loan Documents.
