Statistical and Other Information. PROS retains all right, title, and interest in and to the Subscription Service, Operational Data, Documentation and Professional Services, including all copies and derivative works thereof (by whomever produced), and all related intellectual property rights inherent therein. PROS may use Customer Data processed by the Subscription Service on an anonymized basis to provide, maintain, support, develop, and improve the Subscription Service and PROS machine learning and artificial intelligence technologies, analytics, and other business purposes; provided that in no event will PROS (a) disclose Customer Data in a non- aggregated form or (b) incorporate Customer Data or personal data in a form that could identify Customer, Customer Data or any individual. If Customer purchases Professional Services, PROS grants Customer a worldwide, non-exclusive, non- sublicensable, non-transferable license to use the Professional Services solely for Customer’s use with the Subscription Service. Except for the rights as expressly granted herein, Customer will not acquire any rights by implication, estoppel or otherwise. Customer will not delete or in any manner alter the copyright, trademark, and other proprietary notices of PROS.

The Energy Commission may send the Recipient similar questionnaires after the Agreement term ends. Responses to these questionnaires will be voluntary.   • FACILITIES, EQUIPMENT AND OTHER MATERIALS Except as otherwise specifically provided in this Agreement, CONTRACTOR shall, at its sole cost and expense, furnish all facilities, equipment, and other materials which may be required for performing services pursuant to this Agreement. At COUNTY’s discretion, COUNTY may make equipment or facilities available to CONTRACTOR for CONTRACTOR’s use in furtherance of this Agreement only where a COUNTY Facility or Equipment exhibit is attached to this Agreement identifying the equipment or facilities to be used by CONTRACTOR’s personnel. If COUNTY funds equipment as part of this contract, COUNTY will retain Equipment.

  • Utilities and Other Services 4.4.1 The Tenant shall arrange, at its own cost and expense, for the installation, connection and supply of all utilities and any other services required by it at or in relation to the Premises.

  • Notices and Other Communications Any and all notices, statements, demands or other communications hereunder may be given by a party to the other by mail, facsimile, telegraph, messenger or otherwise to the address specified in Annex II hereto, or so sent to such party at any other place specified in a notice of change of address hereafter received by the other. All notices, demands and requests hereunder may be made orally, to be confirmed promptly in writing, or by other communication as specified in the preceding sentence.
