Subcontractor and Vendor Approval. CLEC shall select an equipment installation vendor which has been approved as a CBT certified vendor to perform all engineering and installation work required in the Physical Collocation Space. CBT shall provide CLEC with a list of certified vendors upon request. The certified vendor shall be responsible for installing CLEC's equipment and components, performing operational tests after installation is complete, and notifying CBT's equipment engineers and CLEC upon successful completion of installation. The certified vendor shall xxxx XXXX directly for all work performed pursuant to this Agreement and CBT shall have no liability for nor responsibility to pay such charges imposed by the certified vendor. CBT shall consider, and shall not unreasonably deny, certifying CLEC, or vendor of its request, as a certified vendor. Notwithstanding the foregoing, CLEC may elect to contract to repair or maintain its equipment, with contractors approved by CBT. Approval by CBT will be based on the same criteria CBT uses in approving contractors for its own purposes. For contractors not previously approved by CBT, CBT will provide written approval/disapproval of any CLEC selected contractor within 20 calendar days. If CBT does not approve the CLEC selected vendor or contractor, CBT will provide CLEC the reason for the disapproval in writing.

All installation work, whether performed by Requesting Carrier or an Ameritech-approved vendor, shall comply in all respects with Ameritech’s technical, engineering and environmental requirements and is subject to Ameritech’s inspection upon completion of such work. Requesting Carrier shall be solely responsible for all costs associated with the planning, installation and maintenance of its Collocated equipment.

SBC-AMERITECH shall permit CLEC to subcontract the construction and build-out of Physical Collocation arrangements with contractors approved by SBC-AMERITECH which approval shall not be unreasonably withheld. Approval of such subcontractors and vendors by SBC-AMERITECH shall be based on the same criteria it uses in approving contractors for its own purposes. Upon request, SBC-AMERITECH will provide CLEC with the written policies used in determining whether or not a contractor will be approved. In addition, SBC-AMERITECH shall allow CLEC to have an SBC-AMERITECH-approved vendor install updates to collocated equipment, including software updates.
