Interference of this right by HC is not in contravention of the Act if it is in accordance with the law and is necessary, justified and proportionate in a democratic society in the interests of:  Public Safety;  National Security;  Prevention of crime and disorder;  Protecting the rights and freedoms of others. The principle of “proportionality” is a common theme that runs through both the European Convention on Human Rights and judgements of the European Court of Human Rights (ECHR). It is explicitly expressed in the limitations contained in Articles 8-11 where it is stated that any interference or restriction of those rights must be lawful and “necessary in a democratic society”. Any restriction of rights must, therefore, be justified in that a fair balance must be achieved between the protection of an individual’s rights and general interests of society. In the context of information exchange, any disclosure of information should be restricted to a minimum and be the least damaging that is required in achieving the objective.
