Construction Management Fee definition

Construction Management Fee means a fee or other remuneration for acting as general contractor and/or construction manager to construct improvements, supervise and coordinate projects or to provide major repairs or rehabilitation on a Property.

• The Construction Management Fee shall be payable from the Operating Account or from other funds timely provided by Company.

• Company shall not have the right to terminate this Agreement except in the event of a termination “for cause.” In the event of a termination of this Agreement pursuant to this Section 15.1, Property Manager shall be entitled to receive the Property Management Fee, the Construction Management Fee and the Leasing Fees accruing as of the effective date of termination, regardless of when such fees are payable.

There shall be no duplication of any amount to be paid as Pre- Construction Services Fee and Construction Management Fee.

Construction Management Fee means a fee payable to the Authority for the management, supervision or review of the construction of a Health Facility, including the letting of contracts for the design, acquisition, construction, reconstruction, rehabilitation or improvement of a Health Facility, the performance of the duties and powers relating thereto expressly granted to the Authority pursuant to the Lease and all other matters incidental thereto;

The increase is not a Lump Sum; it represents 5% of the increase to the GMP. If unspent funds (contingency, sales tax savings or allowances) are returned to the Owner at the conclusion of the Project, the Construction Management Fee shall be reduced by 5% of the amount of the unspent funds returned to the Owner. In no case, however, shall the Construction Management Fee be less than the Lump Sum Fee of $1,060,000.00 contained in the Agreement. Schedule: There is no time extension required for this increased Work. The Date of Substantial Completion remains March 11, 2009.
