Dam Facilities definition

Dam Facilities means the improvements to be constructed by GBRA to repair, restore and improve the Lake Dunlap dam, as more particularly described in the Dunlap Engineering Documents, together with other improvements deemed necessary and appropriate by GBRA to restore the proper operation of the dam facilities and water levels within Lake Dunlap, and any subsequent repairs, extensions and improvements theretodeemed necessary and appropriate by GBRA, and approved by the WCID (to the extent the WCID will fund any costs thereof), to maintain the proper operation of such facilities.
Dam Facilities means the existing Lake XxXxxxxxx dam including all related appurtenances, sites, rights-of-way, easements, and all enlargements, extensions, or improvements thereto together with (1) the Initial Improvements to be constructed by GBRA to repair, restore and improve the dam, and (2) other future improvements, repairs, extensions and restorations thereto deemed necessary and appropriate by GBRA, and approved by the WCID, to maintain the proper operation of the Lake XxXxxxxxx dam and water levels within Lake XxXxxxxxx, as more particularly described in Exhibit “ ”.
Dam Facilities means the existing Lake Placid dam including all related appurtenances, sites, rights-of-way, easements, and all enlargements, extensions, or improvements thereto together with (1) the Initial Improvements to be constructed by GBRA to repair, restore and improve the dam, and (2) other future improvements, repairs, extensions and restorations thereto deemed necessary and appropriate by GBRA, and approved by the WCID, to maintain the proper operation of the Lake Placid dam and water levels within Lake Placid, as more particularly described in Exhibit “A.”

Examples of Dam Facilities in a sentence

  • Upon satisfaction of all conditions precedent set forth herein, GBRA shall follow all legal requirements applicable to the advertisement, bidding and award of one or more contracts for construction of the Dam Facilities.

  • The WCID shall also have all reasonable access to GBRA’s contracts, books and records relating to the construction of the Dam Facilities.

  • Under such circumstances, GBRA shall cause the WCID to be named as an additional insured on all insurance and risk pool coverages that pertain to the Dam Facilities.

  • Such meetings shall include review of actual costs compared to budget, design and construction status, design modifications/change order review, key project issues, permitting status, historical and projected operating costs, Dam Facilities Gantt chart review and safety; and (v) The WCID shall have reasonable access to copies of all Dam Facilities design documents, construction documents, all correspondence with design engineers and contractors whether complete or in draft process.Section.

  • The Board then considered matters relating to the funding and construction of improvements to the Lake Dunlap Dam Facilities.

  • Notwithstanding the foregoing, to the extent that it is determined that the WCID must have an ownership interest or contract rights in the Dam Facilities in order to lawfully fund any payments for which it is responsible hereunder, GBRA agrees to convey to the WCID such undivided ownership interest or contract rights in the facilities constructed.

  • GBRA agrees that the acquisition, construction and improvement of the Dam Facilities has been and will be accomplished in accordance with generally accepted engineering practices, and subject to the issuance of the Bonds to provide part or all of the source of funds, will be completed and operational as soon as reasonably practicable.

  • If after receiving bids or proposals GBRA is satisfied with the bids or proposals received, GBRA shall award a contract for construction of the Dam Facilities, and shall then proceed with construction of the Dam Facilities with diligence following the receipt of sufficient funds to pay the estimated Capital Costs of the Dam Facilities.

  • Subject to the terms and provisions of this Contract, GBRA will provide and pay for the costs of the Dam Facilities through the issuance of the Bonds.

  • The Parties contemplate that the Dam Facilities shall be designed in accordance with the Dunlap Engineering Documents attached hereto, but GBRA shall retain ultimate discretion to determine the final design of the Dam Facilities.

Related to Dam Facilities

  • New Facilities means facilities for which, by the cut-off date, neither of the following events has occurred:

  • Generating Facilities means Interconnection Customer’s device for the production and/or storage for later injection of electricity identified in the Interconnection Request, but shall not include the Interconnection Customer’s Interconnection Facilities. Generation Interconnection Customer:

  • Production Facilities (7 9) means "production equipment" and specially designed software therefor integrated into installations for "development" or for one or more phases of "production".

  • Existing Facilities means all existing buildings and other facilities, the sites for the buildings or facilities, and furnishings or equipment for the buildings or facilities located on real property acquired by the building authority under the terms of this act.

  • Project Facilities means any facilities to be constructed, provided, rehabilitated, operated and/or maintained under the Project;

  • Related facilities means any ancillary facilities owned by the Company which are —

  • Wastewater facilities means the structures, equipment, and processes required to collect, carry away, and treat domestic and industrial wastes and dispose of the effluent.

  • Idle facilities means completely unused facilities that are excess to the governmental unit's current needs.

  • Public facilities means amenities that are—

  • Other Facilities means athletic stadiums, swimming pools, any associated structures or related equipment tied to such facilities including, but not limited to, grandstands and night field lights, greenhouses, facilities used for non-instructional or non-educational purposes, and any structure, building, or facility used solely for school administration;

  • Interconnection Facilities means the Transmission Owner Interconnection Facilities and the Customer Interconnection Facilities.

  • Local Facilities means working capital facilities provided to a Grantor (other than Beverage Packaging Holdings (Luxembourg) I S.A., Beverage Packaging Holdings (Luxembourg) II S.A. Beverage Packaging Holdings (Luxembourg) III S.à.x.x. and the Borrowers) by a Local Facility Provider and “Local Facility” means any of them.

  • Common Facilities means the facilities under D.G.sets/D.G.rooms, water storage tanks its pumping and supply system, sewerage & drainage systems, electric sub-station/ transformers/electric panels/distribution network, maintenance service rooms, lawns including lighting & services etc., roads, pathways & driveways including street lighting & services etc., guard posts, fire hydrants & fire fighting system etc. and all such facilities and areas for common use and excluded from the computation of Super Area of the Said Premises;

  • Generating Facility means the Generating Unit(s) comprising Seller’s power plant, as more particularly described in Section 1.02 and Exhibit B, including all other materials, equipment, systems, structures, features and improvements necessary to produce electric energy and thermal energy, excluding the Site, land rights and interests in land.

  • Term Facilities means the Term A Facility and the Term B Facility.

  • Shared Facilities means the gentie lines, transformers, substations, or other equipment, permits, contract rights and obligations, and other assets and property (real or personal), in each case, as necessary to enable delivery of energy from Seller’s electric generating facility (which is excluded from this definition of Shared Facilities) to the Point of Interconnection that are used in common with other entities, as applicable.

  • Railroad facilities means right of way and related

  • Additional Facilities has the meaning assigned to that term in Section 2.9(a).

  • Facilities means the Plant and Equipment to be supplied and installed, as well as all the Installation Services to be carried out by the Contractor under the Contract.

  • Utility Facilities means the plant, equipment and property, including but not limited to the poles, pipes, mains, conduits, ducts, cable, wires, plant and equipment located under, on, or above the surface of the ground within the public right-of-way of the city and used or to be used for the purpose of providing utility or telecommunications services.   • Recreational Facilities means spas, saunas, steam baths, swimming pools, exercise, entertainment, athletic, playground or other similar equipment and associated accessories.

  • Debt Facilities means one or more debt facilities (including, without limitation, the Credit Agreement) or commercial paper facilities with banks or other institutional lenders providing for revolving credit loans, term loans, receivables financing (including through the sale of receivables to such lenders or to special purpose entities formed to borrow from such lenders against such receivables) or letters of credit or issuances of debt securities evidenced by notes, debentures, bonds or similar instruments, in each case, as amended, restated, modified, renewed, refunded, replaced or refinanced (including by means of sales of debt securities) in whole or in part from time to time (and whether or not with the original administrative agent, lenders or trustee or another administrative agent or agents, other lenders or trustee and whether provided under the original Credit Agreement or any other credit or other agreement or indenture).

  • Parking Facilities means parking lots or other off-street areas for the parking of vehicles, including areas below or above the surface of streets.

  • Vending facility means automatic vending machines, cafeterias, snack bars, cart service, shelters, counters, and such other appropriate auxiliary equipment which may be operated by licensed managers and which is necessary for the sale of newspapers, periodicals, confections, tobacco products, foods, beverages, and other articles or services dispensed automatically or manually and prepared on or off the premises in accordance with all applicable health laws and including the vending or exchange of chances for any lottery authorized by State Law and conducted by an agency of a State within such State.   • Project Facility means facility being one or more of the following facilities as specified in the Special Conditions of Contract, being developed in accordance with the Project and the Detailed Project Implementation Report and includes all its buildings, equipment, facilities, software and systems and includes without limitation, where the circumstances so require, any expansion thereof from time to time and may include any new location to be separately mentioned in the Special Conditions of Contract.

  • Authorized Facilities means the public facilities authorized to be financed, in whole or in part, by the CFD.
