Seller shall provide Buyer with export and import classification data, including, but not limited to, classification numbers according to EU, EU member state, or UK Military Lists, classification numbers according to Annex 1 of Regulation No 428/2009/EC (European Dual Use Regulation), Australian Harmonized Export Commodity Classification (“AHECC”), Export Control Classification Number ("ECCN"), Harmonized Tariff Schedule ("HTS") code or ITAR Category, as applicable.
A marking of the Dual Use classification within the EU is also required if the movement of goods takes place within the EU.
Subrecipient shall identify, report and conduct any research involving life sciences dual use research of concern (as defined by the United States Government Policy for Oversight of Life Sciences Dual Use Research of Concern) in compliance with all applicable Requirements, including, without limitation, DHS Directive 026-08 entitled “Oversight of Life Sciences Dual Use Research of Concern” and any additional Requirements set forth in related DHS policies and instructions.
This Article applies to all research, for which NSF award funds may be used, that potentially falls within the scope of the US Government Policy for Institutional Oversight of Life Sciences Dual Use Research of Concern as published in September 2014, hereafter referred to as the “Policy”.
The Parties agree to observe the following laws of export regulations regarding the use of the Services provided under the Agreement: (i) European Union Dual Use Regulation, (ii) the US Export Administration Regulations, ITAR and the US- Reexport Regulations, (iii) United Nations Sanction Lists, and the embargo lists based on these regulations.
