THESE LIMITATIONS WILL APPLY TO ALL CAUSES OF ACTION, WHETHER ARISING FROM BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY. THE AGGREGATE LIABILITY OF THE CIT PARTIES TO YOU AND ANY THIRD PARTY FOR ANY AND ALL CLAIMS OR OBLIGATIONS RELATING TO THE ONLINE BANKING SERVICES SHALL BE LIMITED TO DIRECT OUT OF POCKET DAMAGES UP TO A MAXIMUM OF $500 (FIVE HUNDRED DOLLARS), UNLESS A LOWER LIMIT IS APPLICABLE TO ANY SPECIFIC SERVICE AS STATED ELSEWHERE IN THISAGREEMENT. Related to Exclusions of Warranties

  • Seller’s Warranties means the warranties given by the Seller pursuant to Clause 9 and Schedule 9, and “Seller’s Warranty” means any one of them;

  • Conditions of Use means Conditions 1 to 10 and the Schedules and Appendices of this document.

  • Company Representations means the representations and warranties of the Company expressly and specifically set forth in Article IV of this Agreement, as qualified by the Company Schedules. For the avoidance of doubt, the Company Representations are solely made by the Company.

  • Limitation of Liability Insert the following Section 15, after Section 14:

  • Seller Warranties means the warranties given by the Seller in Schedule 3;

  • Special Conditions of Contract means the pages completed by the Procuring Entity entitled Special Conditions of Contract which constitute Part A of the Special Conditions.

  • Conditions of Service means the document developed by a distributor in accordance with subsection 2.4 of the Code that describes the operating practices and connection rules for the distributor; (DSC)

  • Purchaser Warranties shall have the meaning ascribed to the term in Clause 8.1;

  • Limited Warranty means the limited warranties and your coverage provided by IKO for your Shingles as expressly set out in this document, and are the only warranties being provided by IKO.

  • Perfection Representations means the representations, warranties and covenants set forth in Schedule 1 attached hereto.
