More Definitions of Labor Difficulties

Labor Difficulties means strikes and other forms of organized actions by labor or other personnel to stop or significantly reduce or slow down work or production or to withdraw or withhold labor or services. “Late Payment Rate” means, as of any date, the lesser of: (a) the prime rate of interest as published in The Wall Street Journal plus 2%, or (b) the maximum interest rate permitted by Applicable Law. “Lien” means any mortgage, charge, lien, claim, security interest or other encumbrance arising out of or in connection with the Construction Manager’s or any of its Subcontractors’ performance of the Services. “XxXxxxx XX0 Pipeline” means the 24-inch diameter pipeline originating at the Gas Treating Plant and ending at the XxXxxxx Pump Station located in McCamey, Texas and all facilities and ancillary equipment relating to such pipeline (as further described in Exhibit B (as Exhibit B may be amended pursuant to Section 2.2)) to be fully designed, engineered, procured, permitted, fabricated and constructed by or on behalf of the Construction Manager as provided in this Agreement. “MMSCFD” means 1,000,000 Standard Cubic Feet per day. “Xxxxxxx” means Xxxxxxx Engineers, Ltd., a Texas limited partnership. “Xxxxxxx Agreements” means, collectively, the Process/Recovery License Technology Agreement, dated May 14, 2008, between XxxxXxxxx Energy, Inc. and Xxxxxxx (as amended May 19, 2008), and the Process/Recovery License Technology Agreement to be entered into by Construction Manager (or its Affiliate) pursuant to Section 2.12(b) with respect to Train 2. “Xxxxxxx Performance Tests” means the performance test referred to in Section 4 of each Xxxxxxx Agreement. “Overall Planned Progress Curve” has the meaning set forth in Section 8.2(a). “Owner” has the meaning set forth in the introductory paragraph. “Owner Related Parties” has the meaning set forth in Section 12.1(a). 5

Related to Labor Difficulties

  • Labor means laborers, mechanics, and other employees below the rank of supervisor, directly employed at the Site of the Work subject to the Manager or their designee’s authority to determine what employees of any category are “required for Extra Work” and as to the portion of their time allotted to Extra Work; and “cost of labor” means the wages actually paid to and received by such employees plus a proper proportion of (a) vacation allowances and union dues and assessments which the employer actually pays pursuant to contractual obligation upon the basis of such wages, and (b) taxes actually paid by the employer pursuant to law upon the basis of such wages and workers’ compensation premiums paid pursuant to law. “Employees” as used above means only the employees of one employer.

  • Labour means worker employed by the Bank/SBIIMS's contractor directly or indirectly through a sub-contractor or other persons or by an agent on his behalf of a payment not exceeding Rs.

  • Occupational Safety and Health Law means any Legal Requirement designed to provide safe and healthful working conditions and to reduce occupational safety and health hazards, including the Occupational Safety and Health Act, and any program, whether governmental or private (such as those promulgated or sponsored by industry associations and insurance companies), designed to provide safe and healthful working conditions.

  • Catastrophic illness or “injury” means an illness or injury that is expected to incapacitate the employee for an extended period of time, or that incapacitates a member of the employee’s family which incapacity requires the employee to take time off from work for an extended period of time to care for that family member, and taking extended time off work creates a financial hardship for the employee because he or she has exhausted all of his or her sick leave and other paid time off.

  • Sabotage means deliberate damage, with malevolent intent, to a Category 1 or Category 2 quantity of radioactive material, a device that contains a Category 1 or Category 2 quantity of radioactive material, or the components of the security system.

  • Labor contractor means an individual or entity, either with or without a contract, which supplies a client employer with, or maintains a pool or availability list of, workers to perform labor within the client employer’s usual course of business. Chronic illnesses or injuries, such as cancer or major surgery, that result in intermittent absences from work and that are long-term in nature and require long recuperation periods may be considered catastrophic.

  • Forced labor or services means labor or services that are performed or provided by another person and are obtained or maintained through coercion.

  • Grievances filed under this Article shall begin at Step 2. Grievances under this clause shall be handled with all possible confidentiality and dispatch.
