Other Funding Agreement definition

Other Funding Agreement means an agreement dated on or about the Commencement Date on terms substantially similar to this Agreement and titled “Studies Funding Agreement – [Prefeasibility] [Feasibility] Study: [insert Expansion details]” between Aurizon Network and another party (or parties) in respect of the Rail Study. Parties means at a time the parties to this Agreement at that time, and Party means any one of them. Pre-feasibility Study has the meaning given in the Access Undertaking.
Other Funding Agreement means the Funding and Indemnification Agreement dated of even date herewith between the Company and the Other Principal Shareholder.
Other Funding Agreement means any agreement for the provision of funding by the Funder to a person with the same, similar or related claims as the Claims.

Examples of Other Funding Agreement in a sentence

  • All Study Funders with a notice confirming any change to the Study Funder’s Study Percentage and “Study Funder’s Study Percentage” under an Other Funding Agreement.

  • Agreements have terminated under clause 2 of those agreements after receipt of the notice given by Aurizon Network under clause 2.7(b), then Aurizon Network must, by notice to All Study Funders terminate this Agreement and each Other Funding Agreement (unless otherwise agreed), in which case clause 2.4 applies.

Related to Other Funding Agreement

  • Master Funding Agreement means the Master Funding Agreement entered into by the Company and the Secretary of State on 31st October 2013;

  • Project Funding Agreement means an agreement in the form of Schedule F that incorporates the terms of this Agreement and enables the LHIN to provide one-time or short term funding for a specific project or service that is not already described in Schedule A;

  • Relevant Funding Agreements means the agreement or agreements entered into by the Company and the Secretary of State under section 1 of the Academies Act 2010 for the establishment of each Academy, including any variation or supplemental agreements thereof;

  • Synthetic Purchase Agreement means any swap, derivative or other agreement or combination of agreements pursuant to which the Borrower or any Subsidiary is or may become obligated to make (a) any payment in connection with a purchase by any third party from a Person other than the Borrower or any Subsidiary of any Equity Interest or Restricted Indebtedness or (b) any payment (other than on account of a permitted purchase by it of any Equity Interest or Restricted Indebtedness) the amount of which is determined by reference to the price or value at any time of any Equity Interest or Restricted Indebtedness; provided that no phantom stock or similar plan providing for payments only to current or former directors, officers or employees of the Borrower or the Subsidiaries (or to their heirs or estates) shall be deemed to be a Synthetic Purchase Agreement.

  • Loan Sale Agreement means the Commercial Loan Sale Agreement, dated as of the date hereof, between the Originator and the Trust Depositor, as such agreement may be amended, modified, waived, supplemented or restated from time to time.

  • Lead Securitization Servicing Agreement means (i) the pooling and servicing agreement or other comparable agreement related to the Lead Securitization, and (ii) on and after the date on which the Mortgage Loan is no longer subject to the provisions of the Lead Securitization Servicing Agreement, the “Lead Securitization Servicing Agreement” shall be determined in accordance with the second paragraph of Section 2(a).

  • Contribution Agreements has the meaning set forth in the Recitals.

  • Master Transaction Agreement has the meaning set forth in the recitals.

  • Non-Lead Securitization Note Holder means any holder of a Non-Lead Securitization Note.

  • Amending Agreement means the Agreement of which a copy is set out in the Third Schedule to the Iron Ore (Hamersley Range) Agreement Xxx 0000 (which Agreement was approved by the Iron Ore (Hamersley Range) Agreement Act Amendment Act 1968);

  • Titling Trust Agreement means the Amended and Restated Trust and Servicing Agreement, dated as of August 26, 1998, among NILT Trust, as the Grantor and the UTI Beneficiary, the Servicer, the Delaware Trustee, the Titling Trustee and the Trust Agent.
