Pending Action definition

Pending Action shall have the meaning set forth in Section 5.04(h) hereof.

Pending Action means the action pending as of the Effective Date between the Parties in the United States District Court for the District of Delaware, Case No. 06-500-SLR (including Case No. 06-500-SLR-MPT), relating to U.S. Patent Nos. 6,018,026 and 5,843,725.
