Physical Product definition

Physical Product means each copy of a Product that is delivered to the End User on a tangible storage medium that is delivered via courier or similar services from Paypro or its Fulfillment Agent to an End User;
Physical Product means all physical items such as game cartridges whether or not currently in inventory or produced by a third party under license or other joint venture agreement, and all proceeds from intellectual property (including proceeds arising out of sales, assignments or licenses) that has ever been or was ever intended to be used to make and sell physical products (including specifically for example but without limitation, the “Minute To Win It” game).
Physical Product means a tangible Product subject to those additional terms and conditions of sale set out in clause 5.5.

  • Any returned Physical Product that is defective or damaged will not be restocked, will be debited from your sales, and will be returned to you at your expense or recycled or destroyed, at 9 Star’s discretion.

  • If, during the Physical Product Warranty Period, it is determined that such Physical Product is defective due to faulty workmanship or defective materials, then Buyer shall obtain from Ingenico a Return Material Authorization (RMA) and return such Physical Product to Ingenico.

  • You acknowledge that 9 Star Media does not carry insurance relating to Physical Product stored by 9 Star under this Agreement, and agree that 9 Star shall have no responsibility or liability for any damage, destruction, loss or other impairment of any of Your Content absent 9 Star’s gross negligence or intentional misconduct.

  • If you do not respond to any return notice from 9 Star within 30 days of the date of the request, or if 9 Star’s attempt to return Physical Product to you is unsuccessful because of an inaccurate address on file with us, then 9 Star shall have the right to recycle, destroy or discard the Physical Product without any compensation or liability to you.

  • If you desire for the your Media when embodied in Physical Product to be insured, then you must obtain such insurance at your expense.


More Definitions of Physical Product

Physical Product means any Physical Gas Product or Physical Oil Product, as applicable;

Unless a product is considered a milk product under this subdivision, milk product does not include dietary products, infant formula, ice cream or other desserts, cheese, or butter.
