Lead Counsel will apply to the Court for a collective award of attorneys’ fees to Plaintiffs’ Counsel to be paid solely from (and out of) the Settlement Fund.
Lead Counsel, Xxxxxxxxx Xxxxxxxx Xxxxxx & Xxxxxxxxx LLP and Xxxxxxx Topaz Xxxxxxx & Check, LLP, on behalf of Plaintiffs’ Counsel, will apply to the Court for an award of attorneys’ fees in an amount not to exceed 25% of the Settlement Fund.
All objections must be filed with the Court and received by Plaintiffs’ Counsel and the Treasurer’s Counsel at the addresses listed below prior to (( )) in accordance with the instructions found on the Treasurer’s website or the Notice.
The Settlement Amount is an all-in settlement number, meaning that it includes all attorneys’ fees to Plaintiffs’ Counsel, administrative costs, expenses, Settlement Class Member benefits, Class Representative awards, and other costs associated with the Settlement.
Plaintiffs’ Counsel have not received any payment of attorneys’ fees for their representation of the Settlement Class in the Action and have advanced the funds to pay expenses incurred to prosecute this Action with the expectation that if they were successful in recovering money for the Settlement Class, they would receive fees and be paid for their expenses from the Settlement Fund, as is customary in this type of litigation.
