To the extent that any of Seller's products delivered hereunder contains a Prohibited Substance, Buyer may deem all of Seller's products to be suspect and all costs incurred in testing, disassembling, reassembling and retesting such products, even if they are ultimately determined not to contain Prohibited Substances, shall be deemed Costs and subject to reimbursement herein.
Any commercial dietary supplement is susceptible to containing substances that may appear on the Prohibited Substance list(s) of FINA and/or the World Anti-Doping Agency.
If Xxxxxxxx determines that a Prohibited Substance has been placed in any Equipment in violation of Applicable Law, Customer shall, at Xxxxxxxx’x option, either (i) promptly pay to Xxxxxxxx the Loss Value of such Equipment, or (ii) restore and decontaminate the Equipment, at Customer’s expense, and provide proof of such decontamination, including, without limitation, methodology and decontamination sampling results and any other inspection or testing Xxxxxxxx deems appropriate.
Immediate Suspension – Illegal Drugs, Impairing Prescription Medication or Prohibited Substances in a sample Should an Illegal Drug, a Prohibited Substance or Impairing Prescription Medication be found to be present in the body of a contestant or any person in a Safety Sensitive Position at the time of testing, they will be suspended for the duration of the rodeo.
Where a laboratory conducting a test for the presence of an Illegal Drug, a Prohibited Substance or an Impairing Prescription Medication reports that the testing of the sample cannot provide an accurate determination of the presence or the amount of the substance in a sample for whatever reason, including that the sample is a dilute sample, the person shall submit to an additional test, if directed by a Calgary Stampede representative.
