Examples of Senior Holder in a sentence
Anything contained in the provisions of this Section to the contrary notwithstanding, any Senior Holder may at any time, by a document specifically exercising such right, subordinate the lien, operation and/or effect of its Senior Instrument to the operation and effect of this Lease without obtaining the Tenant’s consent thereto, by giving the Tenant written notice thereof, in which event this Lease shall be deemed to be senior to such Senior Instrument.
Notwithstanding the foregoing, in the event of an emergency or default that materially interferes with Tenant’s business, Tenant shall not be required to provide notice to the Senior Holder.
The Tenant shall, promptly at the request of the Landlord or the holder of any Senior Instrument (each herein called a “Senior Holder”), execute, acknowledge and deliver such further instrument or instruments evidencing such subordination as the Landlord or such Senior Holder deems necessary or desirable and (at such Senior Holder’s request) attorning to such Senior Holder.
Landlord will not disclose any aspect of Tenant’s financial statements that Tenant designates to Landlord as confidential except (1) to any Senior Holder or prospective purchasers of the Building, (2) in litigation between Landlord and Tenant, and (3) if required by court order.
