Acceptance of Installation. Within thirty (30) days of receipt of written notice from the Contractor that installation and testing of the System(s) is completed, the District shall either accept or reject such System(s) by written notice to the Contractor. Failure to give written notice of acceptance or rejection of System(s) within thirty (30) day period shall constitute acceptance. Any rejection shall expressly state the deficiencies giving rise to the rejection. Upon rejection of the System(s) by the District, the District shall provide the Contractor with reasonable access to correct deficiencies identified, which correction shall be completed within ten (10) days of the date of access. Upon correction, Contractor again shall provide written notice to the District that installation and testing is completed, and the acceptance/rejection process set forth above shall be repeated. This procedure shall continue until the installation of the System(s) is accepted or finally rejected by the District.

Acceptance of Installation. 12.1 If installation of the Products is part of this Contract, Supplier shall notify Buyer when the Products installed will be ready for testing and acceptance, inviting Buyer to attend Supplier’s standard tests or such tests as may have been agreed upon in the Contract to demonstrate compliance with the agreed specifications and/or to inspect the installation work. 12.2 If Buyer fails to attend the testing on the date notified, Supplier will commence with the tests according to Supplier’s standard test procedures and these tests shall be considered performed in the presence of Buyer and acceptance shall in such case take place on the basis of the results stated in the test certificate signed by Supplier. 12.3 If Xxxxx rejects the Products installed it should submit to Supplier the reasons for such rejection in detail and in writing within 10 days after completion of the acceptance tests concerned. If, within Supplier’s reasonable opinion, the rejection is justified, Supplier shall as a sole remedy correct the shortcomings as soon as possible and the relevant parts of the acceptance test shall be repeated within a reasonable period of time in conformity which the procedures outlined above. 12.4 Upon acceptance of the Products, Buyer will sign the acceptance certificate. If, within 10 days after completion of the acceptance test, Supplier has not received the acceptance certificate signed by Buyer or a report with a justified rejection, the Products installed shall be deemed accepted by Buyer. 12.5 Minor defects or deviations not affecting the operational use of the Products installed shall be stated in the acceptance certificate but shall not obstruct or suspend acceptance. Supplier undertakes to remedy such defects as soon as reasonably possible.

Seller will promptly correct any defects for which it is responsible. The job will be considered as fully accepted unless Seller receives notification to the contrary within thirty (30) days after submitting the notice of completion. Not withstanding the foregoing, if Customer places the Products and/or Licensed Materials into service, such action will constitute Customer's acceptance.

Acceptance of Installation. Upon notice from us that the installation of the elevator has been completed, the Purchaser will arrange to have present at the installation site, a person duly authorized to make the final inspection and to provide a written acceptance. The date and time that such person will be present at the site shall be as mutually agreed, but shall not be more than ten business days after the date of our notice to you, unless we both agree to a certain date thereafter. Such final inspection and certificate of acceptance shall not be unreasonably delayed or withheld. If there is more than one (1) unit in this contract, this section shall apply separately to each unit as completed and placed in operation.

Acceptance of Installation. (A) Within thirty (30) days of receipt of written notice from Contractor that installation and testing of the System(s) is completed and upon receipt by Owner of the Contractor’s documentation including, but not limited to, “as-builts”, warranty certification and test results verifying successful testing of the System(s) the Owner shall either accept or reject such System(s) by written notice to Contractor based upon determinations made by Owner’s Technology Designer or Project Coordinator. Failure to give written notice of acceptance or rejection of System(s) within thirty (30) day period shall constitute acceptance. Any rejection shall expressly state the deficiencies giving rise to the rejection. Upon rejection of the System(s) by Owner, the Owner shall provide Contractor with reasonable access to correct deficiencies identified, which correction shall be completed within ten (10) days of the date of access. Upon correction, Contractor again shall provide written notice to Owner that installation and testing is completed and the acceptance/ rejection process set forth above shall be repeated. This procedure shall continue until the installation of the System(s) is accepted or finally rejected by Owner. (B) Upon final rejection by Owner of the System(s), Owner may without prejudice to any other rights or remedies of Owner and after giving Contractor and Contractor’s surety seven (7) days written notice, terminate this Agreement with Contractor and may, subject to any prior rights of the surety take possession of the materials and finish the Project by whatever method Owner may deem expedient. If the Owner terminates this Agreement pursuant to this Paragraph, Contractor shall not be entitled to receive further payment until the Project is finished and accepted by the Owner. If the unpaid balance of the Purchase Price and any other costs and/or expenses due to Contractor exceeds costs of finishing the Project, such excess shall be paid to Contractor. If such costs exceed the unpaid balance of the Purchase Price, Contractor or Contractor’s surety shall pay the difference to Owner. Nothing in Paragraph 5.5 shall be construed to limit Owner’s remedies under any warranty set forth below with respect to System(s).

Supplier will promptly correct any defects for which it is responsible. The job will be considered as fully accepted unless Supplier receives written notification to the contrary within thirty (30) days after submitting the notice of completion. (c) Acceptance shall be effective if executed in writing only by an individual designated by Ordering Company in writing prior to installation start date.
