Access/Utilities. The Property has adequate rights of access to public ways and is served by adequate water, sewer, sanitary sewer and storm drain facilities. Other than as disclosed on the Survey, all public utilities necessary to the continued use and enjoyment of the Property as presently used and enjoyed are located in the public right-of-way abutting the Property, and all such utilities are connected so as to serve the Property without passing over other property. All roads necessary for the full utilization of the Property for its current purpose have been completed and dedicated to public use and accepted by all Governmental Authorities or are the subject of access easements for the benefit of the Property.

Access/Utilities. The Property has vehicular and pedestrian access to and from public ways that is adequate for the use of the Property as of the date hereof, and such access is pursuant to either access easements for the benefit of the Property or as a result of the Real Property abutting a public way. The Property is served by water, sewer, sanitary sewer and storm drain facilities that provide such utilities in amounts that are adequate for the use of the Property as of the date hereof. All public utilities necessary to the continued use and enjoyment of the Property as presently used and enjoyed are located in the public right-of-way abutting the Property, or enter the Property via permanent easements not subject to termination except with the consent of Borrower, and all such utilities are connected so as to serve the Property. All roads providing vehicular and pedestrian access from the Property to public ways are located on either access easements for the benefit of the Property or the Property. All such roads necessary for the full utilization of the Property for its current purpose have been completed.

Access/Utilities. The Trust Property has adequate rights of access to public ways and is served by adequate water, sewer, sanitary sewer and storm drain facilities. Other than as disclosed on the Survey (as hereinafter defined), all public utilities necessary to the continued use and enjoyment of the Trust Property as presently used and enjoyed are located in the public right-of-way abutting the Trust Property, and all such utilities are connected so as to serve the Trust Property without passing over other property. All roads necessary for the full utilization of the Trust Property for its current purpose have been completed and dedicated to public use and accepted by all governmental authorities or are the subject of access easements for the benefit of the Trust Property.

Access/Utilities. The Properties have adequate rights of ---------------- access to public ways and are served by adequate water, sewer, sanitary sewer and storm drain facilities. All public utilities necessary to the continued use and enjoyment of the Properties as presently used and enjoyed are located in the public right-of-way abutting the applicable Individual Property or an adjacent Individual Property, and all such utilities are connected so as to serve the Properties, directly from such public right-of-way, through such adjacent Individual Property or through valid easements insured under the Title Insurance Policies. All roads necessary for the current utilization of the Properties have been completed and dedicated to public use and accepted by all Governmental Authorities or are the subject of access easements for the benefit of the applicable Individual Property or an adjacent Individual Property.

Access/Utilities. The Real Property is served by all utilities and services, including without limitation electrical power, water, sewer and telephone, reasonably necessary for the normal and intended use of the Real Property in connection with the operation of the CATV Systems.

Access/Utilities. The Property (a) is located on or adjacent to a public road and has direct legal access to such road, or has access via an irrevocable easement or irrevocable right of way permitting ingress and egress to/from a public road, (b) is served by or has uninhibited access rights to public or private water and sanitary sewer (or well and septic), storm drainage facilities, and all required utilities, all of which are appropriate for the current use of the Property. All public utilities necessary or convenient for the full use and enjoyment of the Property are located either in the public right of way abutting the Property (which are connected as to serve the Property without passing over other property) or in irrevocable recorded easements servicing the Property and such easements are set forth in and insured by the Title Insurance Policy. All roads and public utilities necessary for the use of the Property for its current purposes have been completed and dedicated to public use and accepted by all Governmental Authorities.

Access/Utilities. The Property has adequate rights of access to public ways and is served by adequate gas, electric, cable, telephone, water, storm sewer, sanitary sewer and storm drain facilities. All public utilities (including, but not limited to, the foregoing) necessary to the continued use, enjoyment, occupancy, operation and disposition of the Property as presently used and enjoyed are located in the public right-of-way abutting the Property, and all such utilities are connected so as to serve the Property without passing over other property. All streets, roads, highways, bridges and waterways necessary for access to and full use, occupancy, operation and disposition of the Land and the Improvements have been completed, have been publicly dedicated and accepted by the appropriate municipal authority and are open and provide public ingress and egress to the Land and the Improvements, or are the subject of irrevocable, perpetual access easements without condition or cost to the Mortgagor and which easements are for the benefit of the Property and subject to the approval of the Administrative Agent. All liquid and solid waste disposal, septic and sewer systems located on the Property are to the Mortgagor’s actual knowledge in a good and safe condition and repair and in compliance with all Applicable Laws.
