Common use of Accommodation of Employees Clause in Contracts

Accommodation of Employees. In accordance with the Human Rights Act, the Employer and the Union will make every reasonable effort to provide alternate employment for an employee who is unable to perform his/her normal duties due to disability, illness or advancing years provided such alternate employment is available and such employee shall not displace an employee with more seniority. (a) On appointment to a vacant position, the successful applicant shall be informed and his/her name shall be posted on all appropriate bulletin boards. (b) The Union shall be notified of all appointments, leaves of absence without pay for periods of two (2) months or greater, hirings, layoffs, transfers, recalls and terminations of employment.
