Additional Rights and Restrictions. Notwithstanding the foregoing, (1) an accelerated payment of all or a portion of the Deferred Amount may be requested upon the occurrence of an Unforeseeable Emergency (as defined in the Plan) and paid in accordance with the terms of the Plan; (2) the Committee reserves discretionary authority to permit a subsequent deferral election with respect to the Deferred Amount in accordance with the terms of the Plan; and (3) if a “specified employee” (as defined in the Plan) becomes entitled to a distribution on account of a separation from service, payment of all or a portion of the Deferred Amount will be delayed in accordance with the terms of the Plan.
Additional Rights and Restrictions. You also have the right to make additional copies of the Windows NT Software Components equal to the number of validly licensed copies of Microsoft BackOffice Small Business Server 4.0 which you have, and you may use each copy in the manner specified above. If you do not have a valid license for Microsoft BackOffice Small Business Server 4.0, you have no rights under the foregoing section.

Additional Rights and Restrictions. THERE MAY BE ADDITIONAL RIGHTS AND RESTRICTIONS SET FORTH IN SUPPLEMENTS OR “PRODUCT SPECIFIC LICENSE TERMS” ON CARDS OR COMPACT DISKS ACCOMPANYING THE SOFTWARE, WHICH ARE HEREBY INCORPORATED INTO THIS AGREEMENT. You agree that such Product Specific License Terms or Supplements may be composed and shall be enforceable in the English language. The Product Specific License Terms may grant You the right to distribute “Distributable Components.” In the event You distribute Distributable Components to third parties, You agree to indemnify, hold harmless and defend Sybase, its affiliates and suppliers from and against any third party claims, including court costs and reasonable fees of attorneys and expert witnesses, arising from the Use or distribution of Your software that includes or contains the Distributable Components. You shall include Sybase’s copyright notice (and the copyright notices of Sybase’s suppliers if required by the Documentation) on all copies of the Distributable Components.
Additional Rights and Restrictions. The parties agree to the following rights and restrictions:
2.1 Society shall have the right to control access and use of the Leased Area during the term of this Lease.
2.2 The parking areas serving Bonham Park are not for the exclusive use of Society. Society shall have the same rights, and be subject to the same restrictions, as the general public in regards to parking.
2.3 City shall have a right of entry for the purpose of inspection of the Leased Area when accompanied by a member of the Society during the normal business hours of the City.
2.4 Subject to the City’s sign ordinance, Society shall have the right to construct signs or displays outside of the Leased Area, with prior written approval of the City Manager.
2.5 City shall be responsible for the maintenance of all grounds near the Leased Area in the same manner and to the same extent as other parks in the city.
2.6 Society will not litter or use space outside of Leased Area for storage.
Additional Rights and Restrictions. If you do not have a valid license for Microsoft Windows 95, you have no rights under the foregoing section.

End User may install the Software on additional passive Nodes in an active/passive configuration deployment where one Node hosts the entire workload (“Active”) and one or more Nodes remains idle as a standby (“Passive”). However, the quantity of Active Nodes at any point in time must be no greater than the quantity of Node licenses that the End User has included in End User’s subscription. End User shall deactivate and uninstall all of the Software upon termination or expiration. The Software Components are licensed as a single Software product and are not licensed separately. Customer may choose which Software Components toActivate.
