Common use of Adjacent Excavation-Shoring Clause in Contracts

Adjacent Excavation-Shoring. If an excavation shall be made, or shall be authorized to be made, upon land adjacent to the Real Property, Tenant shall, upon notice, afford to the person causing or authorized to cause such excavation license to enter upon the Premises for the purpose of doing such work as such person shall deem necessary to preserve the wall or the Building from injury or damage and to support the same by proper foundations. In connection with such license, Tenant shall have no right to claim any damages or indemnity against 62 Landlord, or diminution or abatement of Rent provided that Tenant shall continue to have access to the Premises.
