Adjustment Requests. (a) Except with the written consent of EHI (not to be unreasonably withheld), ALC will not file any Adjustment Request with respect to any Joint Return, unless required by law. Adjustment Requests. If a contract's records require adjustment, Investment Services will notify Security Benefit in writing. Adjustment requests will be processed by Security Benefit on the day of receipt if received by 1:00 pm EST (after 1:00 p.m. EST will be completed by end of next business day). Security Benefit will notify Investment Services of any outstanding adjustment requests weekly . Security Benefit to provide monthly summary of adjustments processed.
Adjustment Requests. Unless the other Party consents to the contrary (which consent will not be unreasonably withheld or delayed), (i) no Adjustment Request with respect to any Tax of any Xxxxxx Consolidated Group will be filed if it could reasonably give rise to an Indemnity Payment by Cable pursuant to this Agreement and (ii) Cable and its Affiliates will make any available elections to waive the right to carry back any Tax attributes of Cable from any Post-Distribution Period of Cable to any Pre-Distribution Period of Cable and will not make any affirmative election to claim any such carryback. Any Adjustment Request that the Parties consent to make under this Section 3.05 will be prepared by the Responsible Party under Sections 3.01 and 3.02 for the Tax Return to be adjusted. The Party requesting the Adjustment Request will provide to the Responsible Party all information required for the preparation and filing of such Adjustment Request in such form and detail as reasonably requested by the Responsible Party.
Adjustment Requests. A Party may request a Reclamation Costs Review by serving a written request (“Adjustment Request”) upon the Reclamation Trust Funds Operating Agent, the members of the Reclamation Oversight Committee and SJCC, setting out in detail the facts relied on by the Party making the request.

If Provider believes a Claim has been improperly adjudicated for a Covered Service for which Provider timely submitted a Claim to Plan or its designee, Provider must submit a Claim Action Request Form ("CARF") or make a request for an adjustment with Plan or its designees within twelve (12) months from the date of Plan's payment or explanation of payment, unless otherwise set forth in the provider manual. The request must be submitted in accordance with Plan's CARF or payment inquiry process. Requests for CARF or adjustments submitted after this date may be denied for payment, and Provider will not be permitted to xxxx Anthem, Plan, or the Covered Individual for those services for which payment was denied.
Adjustment Requests. Any Adjustment Request with respect to any member of the Controlled Group may be made (or caused to be made) only by the Company (or its Subsidiaries) responsible for preparing the original Return with respect to such member under this Agreement. Controlled (or its Subsidiaries) shall not, without the prior written consent of Distributing (which consent shall not be unreasonably withheld or delayed), file, or cause to be filed, any such Adjustment Request to the extent that such filing, if accepted, is likely to increase the Taxes allocated to, or the Tax indemnity obligations under this Agreement of, Distributing for any Tax Period (or portion thereof) by more than a de minimis amount; provided, however, that such consent need not be obtained if Controlled agrees to indemnify Distributing for the incremental Taxes allocated to, or the incremental Tax indemnity obligation resulting under this Agreement to, Distributing as a result of the filing of such Adjustment Request.

If Provider believes a Claim has been improperly adjudicated for Covered Service for which Provider timely submitted a Clean Claim to Plan, Provider must submit a request for an adjustment to Plan per the requirements set forth in the provider manual(s) or applicable Participation Attachment(s). Adjustment requests submitted that do not comply with such requirements may be denied for payment, and Provider shall not be permitted to bill Anthem, Plan, or the Member for those Covered Services for which payment was denied.
Adjustment Requests. A Participant desiring to request a Reclamation Costs Review shall do so by serving a written request (the “Adjustment Request”) upon the Trust Funds Operating Agent and the members of the Reclamation Oversight Committee. A copy of the Adjustment Request shall also be served on SJCC. An Adjustment Request shall set out in detail the facts relied on by the Participant making the request.
