Amendment to Section 6.1(b). Section 6.1(b) of the Lease is hereby amended by inserting “other than any portion of any Tenant Capital Improvement or Material Capital Improvement that is funded with CapEx Project Advances (it being understood and agreed that Landlord shall be treated as the owner of the portion of such Tenant Capital Improvement or Material Capital Improvement that is proportionate to the amount of the CapEx Project Advances that are used to fund the construction of such Tenant Capital Improvement or Material Capital Improvement as compared to the total cost of construction of such Tenant Capital Improvement or Material Capital Improvement, and shall be eligible to claim depreciation deductions under Sections 167 or 168 of the Code with respect thereto)” at the end thereof.
