Amendments/Changes to Account Terms. We may amend or change the terms of this Agreement with you at any time. We may add new terms or delete or amend existing terms, add new services and discontinue existing services, or convert existing services into new services. As required by applicable law, we will provide you 30 days’ prior notice in writing or by any method permitted by law of an adverse change to this Agreement. Reasonable notice may include emailing a notice, a statement message or amended agreement to the last email address we have on file for you. We may substitute similar services or discontinue the currently offered services for certain accounts by giving you 30 days’ prior notice. We do not have to notify you, however, of any changes that are beneficial to you (e.g., a reduction or waiver of any fees or the addition of services) or if the change is required for security reasons. Unless otherwise required by law, we may amend this Agreement without prior notice (e.g., by posting the information on the Mobile App, Website or otherwise making it available to you). When we change this Agreement, the then-current version of this Agreement supersedes all prior versions and governs your Account and any Sub-Account. If you continue to use your Account or any Sub-Account or keep it open, you are deemed to have accepted and agreed to any changes as of the effective date of any such change. If you do not wish to be bound to the changes, you may close your Account as provided in this Agreement. When you close an Account, we also will close all Sub-Accounts.   • Amendments - Changes/Extra Work The Subrecipient shall make no changes to this Contract without the County’s written consent. In the event that there are new or unforeseen requirements, the County has the discretion with the Subrecipient’s concurrence, to make changes at any time without changing the scope or price of the Contract.‌ If County-initiated changes or changes in laws or government regulations affect price, the Subrecipient’s ability to deliver services, or the project schedule, the Subrecipient will give County written notice no later ten (10) days from the date the law or regulation went into effect or the date the change was proposed and Subrecipient was notified of the change. Such changes shall be agreed to in writing and incorporated into a Contract amendment. Said amendment shall be issued by the County-assigned Contract Administrator, shall require the mutual consent of all Parties, and may be subject to approval by the County Board of Supervisors. Nothing herein shall prohibit the Subrecipient from proceeding with the work as originally set forth or as previously amended in this Contract.

PRIME PUBLISHING AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO SUCH DAMAGES ARISING FROM BREACH OF CONTRACT OR WARRANTY OR FROM NEGLIGENCE OR STRICT LIABILITY) ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, EVEN IF WE HAVE BEEN ADVISED OF (OR KNEW OR SHOULD KNOWN OF) THE POSSIBILITY OF SUCH DAMAGES. 14) Disclaimer. PRIME PUBLISHING PROVIDES THE SERVICE "AS IS" WITHOUT WARRANTY OF ANY KIND. 15)

  • Changes to the Terms of Use We may revise and update these Terms of Use from time to time in our sole discretion.
