AMENDMENTS TO THIS TRUST DEED. 23.1 The Trustees shall be entitled to amend this Trust Deed with the prior written consent of Harmony, provided that the amendment is in accordance with the object of the Trust. The Trustees shall not be required to obtain consent of the Beneficiaries in respect of any amendment to this Trust Deed, other than in respect of a proposed amendment which adversely affects or impacts any of the vested rights which the Beneficiaries (current or existing Beneficiaries at the time of the proposed amendment) have in the Trust.

AMENDMENTS TO THIS TRUST DEED. Subject to the provisions of the Facility Agreement, the Trustee may with the agreement of the Founder and with the approval of a Special Vote of the Beneficiaries amend the provisions of this Deed in such manner as they may determine including without limitation the extension of the class of Beneficiaries hereunder and all such amendments shall be binding on the parties hereto and on the Beneficiaries and on all future Beneficiaries.
