Common use of Amicable Resolution; No Work Stoppage Clause in Contracts

Amicable Resolution; No Work Stoppage. It is the parties' intention to resolve any disputes under the Contract amicably, if at all possible, by reasonable businesslike negotiations and without resort to litigation. Whether or not the parties succeed in resolving the dispute amicably, and irrespective of the size or nature of the dispute, Contractor shall not be allowed in any way to slow down, delay or stop performance of the Work hereunder or any of its obligations under the Contract Documents during the pendency of any dispute. If Contractor slows down, delays, or stops performance because of a dispute, Contractor shall be responsible to Owner for all costs, losses, and damages of any kind Owner suffers as a result of such slow down, stoppage or delay.
