Ancillary Income. Seller shall be entitled to retain as additional compensation any Ancillary Income and any Prepayment Interest Excess received by Seller with respect to the Deferred Mortgage Loans, to the extent such Ancillary Income or Prepayment Interest Excess is permitted to be retained by Seller pursuant to the related Deferred Servicing Agreement.
Ancillary Income. Ancillary income received by Equitable in connection with the licensing of the name of the Malls, the furnishing of utilities from the Mall to third parties and the like shall be adjusted as of the Adjustment Point between Equitable and Purchaser. 6.4

Notwithstanding anything herein to the contrary, all components of Servicing Income and Professional Services Income for any calendar month based on fees or charges billed directly to borrowers shall be determined as if the rate for each such fee or charge utilized by SPS is the same as the rate for such fee or charge utilized by SPS during the six months prior to the Option Closing Date (regardless of whether SPS actually continues to impose such fees or charges at such rates) or, if greater, the highest rate for such fee or charge actually utilized by SPS in the applicable jurisdiction during such calendar month for the Portfolio Mortgage Loans; provided, however, that:
Ancillary Income. Ancillary income received by Owner (and any successors to Owner) in connection with the furnishing of utilities from the Property to third parties, the leasing of kiosks, antennae, baby strollers and other items and the like shall be adjusted as of the Adjustment Point between the Sellers and Purchaser.
Ancillary Income. During the Term, in the event HOLA obtains income from uses of the Premises which are ancillary to the uses contemplated under this Lease (e.g., uses contemplated in Section 17.1 herein), HOLA shall use such income only for such purposes as are consistent with the nonprofit activities permitted with respect to the use of the Premises. Any receipt of such income shall be reported to CITY in the annual report required pursuant to Section 8.1, and HOLA, if requested by the General Manager, shall provide the General Manager with such accountings as the General Manager shall reasonably require to demonstrate compliance with this Section 5.8. Nothing in this Section shall be construed to permit uses of the Premises not otherwise allowed under the provisions of this Lease, nor shall anything in this Section be construed to negate or modify any requirement for prior approval of activities.

During the Term, in the event HEART OF LA obtains income from uses of the Premises which are ancillary to the uses contemplated under this Sublease (e.g., uses contemplated in Section 5.1 herein), HEART OF LA shall use such income only for such purposes as are consistent with the nonprofit activities permitted with respect to the use of the Premises. Any receipt of such income shall be reported to HOLA and CITY in the annual report required pursuant to Section 8.1, and HEART OF LA, if requested by HOLA or the General Manager, shall provide HOLA or the General Manager, as applicable, with such accountings as HOLA or the General Manager shall reasonably require to demonstrate compliance with this Section 5.8. Nothing in this Section shall be construed to permit uses of the Premises not otherwise allowed under the provisions of this Sublease, nor shall anything in this Section be construed to negate or modify any requirement for prior approval of activities.
Ancillary Income. Subservicer may charge Mortgagors ancillary fees related to the performance of the Subservicing Functions and for services or products provided, including late charges, NSF fees, assumption fees and other incidental fees or charges, in all cases in a manner consistent with its past practices (collectively, "Ancillary Income") as are permitted by all applicable Regulations. Principal shall be entitled to all such Ancillary Income.
Ancillary Income. Commissions and other income earned on optional insurance premiums received that are related to the Mortgage Loans and such other fees earned from other solicitations of Mortgagors.
Ancillary Income. Sub-Servicer will retain all Ancillary Income as defined herein, in addition to the sub-servicing compensation provided in Article VI of this Agreement.
