AND JURISDICTION. 1.1 The Employer hereby recognizes the Union as the exclusive bargaining agent for all Employees who perform work within the scope of this Agreement and the Union recognizes the Associations as the bargaining agents for any contractor who assigns its bargaining rights to an Association, and any independent contractor who signs this Agreement or otherwise agrees to be bound by it and who employs Employees within the territorial jurisdiction of the Union as set forth in this Article I unless such independent contractor has given proper notice under paragraph
AND JURISDICTION. The employer recognises the Union as the sole bargaining agent for all its employees in the Xxxxx Airport, save and except Supervisors and persons above the rank of Supervisors. An employee promoted to a position excluded from the bargaining unit shall not accumulate seniority during absence from the bargaining unit. In the event the employee bids for and is awarded a job posting back within the bargaining unit will be entitle to seniority accumulated up to the day in which was promoted to a position excluded from the bargaining unit. The Employer agrees that an employee may elect to return to former position within the first thirty-day (30) period, thereafter may return to a vacancy within the bargaining unit as a new employee. No employee shall be laid off because of sub-contracting. Unless the nature of the services to be subcontracted is outside the present duties of the employee group and the employer is unable to retrain the employees in a time period.
AND JURISDICTION. (a) The employer voluntarily recognizes the Union as the sole bargaining agent for all its employees in the Airport, save and except Supervisors and persons above the rank of Supervisors. The Employer recognizes the Union as the sole bargaining agent for the employees who are or will be unionized. An employee promoted to a position excluded from the bargaining unit shall not accumulate seniority during absence from the bargaining unit. In the event the employee bids for and is awarded a job posting back within the bargaining unit will be entitled to seniority accumulated up to the day in which was promoted to a position excluded from the bargaining unit. AND JURISDICTION. The Union is recognized as the sole and exclusive bargaining agent for all employed by INVESTIGATION SECURITY its' assigns or successors, in Halifax, Nova Scotia, save and except those who have been excluded by virtue of the certification orders of the Canada Labour Relations Board. An employee awarded a permanent position excluded from the bargaining unit shall be on probation for a period of ninety (90) work days in total from the first day of leaving the bargaining unit. In the event that the employer or the employee determines (within the ninety day period) that the employee is not suited for the position he shall be allowed to return to the bargaining unit. The employer agrees to deduct union dues as contained in Article of this agreement and to remit them to the Union during the ninety day period. After the probationary period an employee may return to the bargaining unit as a new employee without seniority. These time frames may be extended upon mutual agreement by both parties. An employee has the right to use this clause only once during the life of this agreement. No employee shall be laid off because of sub-contracting. The Employer agrees not to enter into any agreement or contract with the employees covered by this agreement, individually or collectively, which in any way conflicts with the terms and provisions of this agreement or any statute of the Province of Nova Scotia and Canada. Any such agreement will be null and void.
AND JURISDICTION. The Company recognizes the Union as the sole bargaining agent for those employees at Canada Corp. Plant, covered by the Certification and working at the classified occupations listed in Appendix "A", and for such other employees as may be assigned to new classifications coming under the Union's jurisdiction, save and except assistant supervisor, persons above the rank of assistant supervisor, security guards, office, clerical and sales staff.
AND JURISDICTION. This Agreement shall be governed in all respects by and interpreted in accordance with the laws of the State of Arizona. Each of the Parties hereto consents to such jurisdiction for the enforcement of this Agreement and matter; pertaining to the transaction and activities contemplated hereby.
AND JURISDICTION. For the purpose of negotiation and application of this Collective Agreement, the Employer recognizes the University Part-time Faculty Association as the only official representative and the only negotiating body for all part-time faculty included in the certification issued by, the travail et de la on September (See Appendix A). For the purpose of administration of the Collective Agreement, unless otherwise stipulated, the Labour Relations Office shall act on behalf of the Employer. ARTICLE GENERAL RIGHTS
AND JURISDICTION. This agreement shall be governed by Indian Law and the courts of law in India will have exclusive jurisdiction in any matter arising from or relating to this Agreement to the exclusion of all other courts that may have had jurisdiction in the matter.
AND JURISDICTION. Section 7.01 - Indemnity. XXXXXX and XXXXXXXX agree to mutually indemnify one another and save harmless one another against all losses, costs or Humftggs arising out of any injury to persons or property occurring in the performance of this Agreement, or resulting from the failure ofthe Joint Conveyance System to function properly from any cause except due to negligence.
AND JURISDICTION. (a) The Employer recognizes the Union as the sole collective bargaining agency for all the employees of Abitibi-Consolidated Inc., Woodlands Division, including ail employees on the seniority of Consolidated Inc., in xxxxx operations on the Grand Falls timber limits save and except Woodlands Manager, Assistant Woodlands Manager, Superintendents, Assistant Superintendents, General Foremen, Foremen, Assistant Foremen, Scalers, Assistant Scalers, Technical, Clerical and Office Staff, Guards, Gatekeepers, Non-Working Contractors, Non- Working Sub-Contractors, persons employed in Silviculture operations, persons employed in supervisory, advisory and confidential capacities. Members of the Union who are promoted outside the Union will retain seniority and accumulated seniority for a period not exceeding three (3)
