Appearance in Court. When an employee is required by the Employer to appear in any court or before any attorney-at-law for the purpose of testifying because of any accident he may have been involved in during working hours, such employee shall be reimbursed in full by the Employer for all time spent computed at his current hourly rate of pay, or the daily minimum whichever is greater, because of such appearance.

Appearance in Court. 21.01 An employee summoned to appear or required to serve jury duty or one who have been served with a subpoena to appear as a witness shall be paid the difference between what the employee would have earned for their scheduled hours at their paid rate and the court fee received. Employees should notify their Xxxxxxx as soon as possible after receipt of notice of selection for jury duty or after receipt of the subpoena to appear as a witness. The Company may require the employee to furnish a certificate of service from an officer of the court before making any payment under this Section. Leaves under the provisions of this clause shall be recognized and granted on a full day basis and apply to all shifts. An employee charged with a criminal offense and subsequently found guilty shall not be entitled to remuneration under this clause.

In case of absence in response to a subpoena in (1) a court proceeding, or (2) an administrative hearing, in which neither the employee nor a labor organization recognized by the Board is a party, the Board shall deduct from the employee’s salary only the amount of any witness fee or other compensation in excess of thirty-five dollars ($35.00) per day. 2. In the case of absence from duty for a court proceeding, or an administrative hearing in which the employee or the Federation is a party, no salary shall be paid to the employee for the period of absence, except as allowed under appropriate sections of Board policies, unless in the judgment of the Superintendent the employee should receive pay because the court proceeding or administrative hearing arises from a justifiable line of duty action on the part of the employee. 3. If an employee is summoned for jury duty and is excused by the court without compensation, the employee shall report to work immediately and shall suffer no loss of pay.
Appearance in Court. In the event that an employee must appear in court for jury duty or as a witness in a school-related matter where the Board is not an adverse party, the Board will compensate the employee at the regular rate of pay minus any amount received for such court services.

Unless the District has hired a substitute for that day, the employee must return to work in cases where it is not necessary to be absent the entire day.

The employee will come to work during those regular hours that he is not required to attend the court.

An Employee required to appear in any court as a direct result of his police duties, on his off-duty hours, shall be paid one and one-half (1-1/2) times the Employee’s hourly rate for actual hours worked, with a minimum credit of 2 hours at time and a half, unless otherwise prescribed by this Agreement. 2. The Director shall from time to time, issue directives concerning the scheduling of court appearances which are designed to minimize overtime. 3. Those employees who are required to appear in court between shifts will receive three (3) hours of overtime at one and one-half (1½) times their regular rate of pay.
