Appropriation by Legislature. The Department’s performance and obligation to pay under this Agreement is contingent upon an annual appropriation by the Legislature. If funds are not appropriated for the Department to operate the Park or maintain the Facilities allotted for the Concessionaire, the Department may terminate this Agreement after giving the Concessionaire 30 days’ written notice.
