The Application is available through your mobile device when it is within the operating range of a wireless carrier and through your Lexus Vehicle’s compatible multimedia system when the Vehicle is turned on. The Application is subject to transmission limitation or interruption. Lexus does not guarantee that the Application (or any portion thereof) will be available at all times and/or in all areas. You acknowledge and agree that Lexus is not responsible for performance degradation, interruption or delays. You acknowledge that Lexus shall not be liable to you if the Application in a given location is not available. If the Application is not available within your intended location, you agree that your sole remedy shall be to cease using the Application and cancel your registration.

You acknowledge that the actual time between occurrence of an event (“Event”) triggering a selected Control or Alert and the time the notification of such event is sent to Your mobile device (“Notification”) is dependent on a number of factors including, without limitation, Your wireless service and coverage within the area in failures, or face other transmission problems. Similarly, selection of Controls and Alerts (collectively, “Commands”) are likewise affected by the same or similar factors and problems could arise and use of Commands. Notifications of Events may not be available to be sent to Your mobile device in all areas. If you register to receive Notifications to Your mobile device, the Manage Debit Card feature is available when You have Your mobile device within the operating range of a wireless carrier with an appropriate signal for data services. The Manage Debit Card feature is subject to transmission limitations and service interruptions. Bell Bank does not guarantee that the Manage Debit Card feature (or any portion thereof) will be available at all times or in all areas. You acknowledge and agree that certain functionality with eh Manage Debit Card feature may not be available for all transactions. Commands based upon the location of the mobile device where the Manage Debit Card feature is installed or the location of the merchant where the card is being attempted for use may not apply appropriately to card-not-present transactions or transactions where the location of the actual location of the merchant differs from the merchant’s registered address. You acknowledge and agree that neither Bell bank nor its third0party services providers (including the developer of the technology enabling the Notifications) are responsible for performance degradation, interruption, or delays due to conditions outside of its control. You acknowledge that neither Bell bank nor its third-party service providers shall be liable to You if You are unable to receive Notifications on Your mobile device in Your intended area. Bell Bank. For itself and its-third party service providers, disclaims all liability for any delays, mis-delivery, loss, or failure in the delivery of any Notification, any form of active or passive filtering.

You, and not Elan, are responsible for, without limitation, obtaining and maintaining all telecommunications, broadband, Equipment and services needed to participate in the Program and access and use any websites provided for this purpose, including without limitation the registration pages, if applicable. You acknowledge that Elan, agencies, participating Merchants, ISPs and FreeMonee shall not be liable to you if any Gift, web page or registration page is unavailable, interrupted or suspended for any reason. If any Gift, web page or registration page is unavailable, or is interrupted or suspended, you agree that your sole and exclusive remedy shall be to terminate this Agreement. “
Availability/Interruption. Service will be available only within the operating range of each Carrier's wireless system ("Service Area"). Subject to §6.3 below, AWS may from time to time add or delete Service Areas upon written notice to Customer. Service is subject to: (a) transmission limitation, reduction in transmission speed, or interruption caused by weather, your Equipment, terrain, obstructions such as trees or buildings, and other conditions; (b) temporary suspension due to governmental regulations or orders, system capacity limitations, system repairs or modifications, or in response to suspected fraud, abuse, misuse of the network, hacking or malicious viruses; (c) interruption for Customer’s nonpayment of charges by Customer; and (d) call blocking for certain categories of numbers (e.g., 976, 900 and certain international destinations) or access to certain websites if, in AWS' sole discretion, AWS is experiencing excessive billing, collection, fraud problems or other misuse of the AT&T Wireless network.

This map may include areas served by unaffiliated carriers and may depict their licensed area rather than an approximation of their coverage. Actual coverage may vary and depends on system availability and system capacity, system repairs and modifications, customer’s equipment, terrain, signal strength, weather and other conditions. Wireless For Dummies™ does not guarantee coverage or network availability. GSM wireless features require a compatible GSM 850/900/1900 dual, tri, or quad band phone, are only available in the GSM features area. Not all features or Service offerings are available at all locations. Charges will be based on the location of the site receiving and transmitting the call, not your location. Rates apply to calls made within the Wireless For Dummies™ Coverage Area. Your phone's display does not indicate the rate you will be charged.

Service is subject to interruption when telecommunication service is subject to transmission limitation and/or interruptions including access to the public Internet.
