Banking Activities. Without limiting the provisions of Section 2.4, the Member or any Authorized Officer is authorized to act on behalf of the Company and in its name:
(a) to establish bank accounts on behalf of the Company;
(b) to sign checks, drafts, instruments, bills of exchange, acceptances and/or other orders for the payment of money from any bank account;
(c) to endorse checks, instruments, evidences of indebtedness, and orders payable, owned or held by the Company;
(d) to accept drafts, acceptances, instruments and/or other evidences of indebtedness payable at or through the bank at which any bank account is maintained;
(e) to waive presentment, demand, protest and notice of protest or dishonor of any check(s), instrument(s), draft(s), acceptance(s), or other evidences of indebtedness made, drawn or endorsed by the Company;
(f) to enter into one or more agreements with one or more banks, which will be deemed to govern the bank accounts established at such bank;
(g) to authorize the purchase, on behalf of the Company, of CDs, bonds, notes and other such savings instruments from each bank;
(h) to obtain, on behalf of the Company, other related services from any bank, such as the rental of safe deposit boxes from such bank, obtaining of night depository services, routine cash management services, and the like, which will be governed by night depository agreement(s), safe deposit box lease agreement, and any other such agreement(s) contained on the application or signature cards pertaining to any such services offered to the Company by such bank, as amended from time to time;
(i) to sign and execute signature cards, applications and forms as any Bank will deem appropriate, from time to time, in connection with the opening and maintaining of bank accounts at such bank and/or obtaining any of the aforementioned additional related services; RLF1 28406131v.1
(j) to execute applications for the issuance of any savings instrument in the name of the Company; and
(k) to otherwise deal with each bank in connection with the foregoing activities on behalf of the Company.
Banking Activities. Without limiting the generality of Section 2.3, the Initial Beneficiary or the Titling Trust Administrator is authorized to act on behalf of the Titling Trust and in its name:
(a) to establish bank accounts on behalf of the Titling Trust (each, a “Titling Trust Account”);
(b) to sign checks, drafts, instruments, bills of exchange, acceptances and/or other orders for the payment of money from any Titling Trust Account;
(c) to endorse checks, instruments, evidences of indebtedness, and orders payable, owned or held by the Titling Trust;
(d) to accept drafts, acceptances, instruments and/or other evidences of indebtedness payable at or through the bank at which any Titling Trust Account is maintained (each, a “Bank”);
(e) to waive presentment, demand, protest and notice of protest or dishonor of any check(s), instrument(s), draft(s), acceptance(s), or other evidences of indebtedness made, drawn or endorsed by the Titling Trust;
(f) otherwise to deal with each Bank in connection with the foregoing activities on behalf of the Titling Trust;
(g) to enter into one or more agreements with the Bank, which will be deemed to govern the Titling Trust Accounts established at such Bank;
(h) to authorize the purchase, on behalf of the Titling Trust, of CDs, bonds, notes, commercial paper, money market funds, and other similar savings or investment instruments from each Bank;
(i) to obtain, on behalf of the Titling Trust, other related services from any Bank, such as the rental of safe deposit boxes from such Bank, obtaining of night depository services, routine cash management services, and the like, which will be governed by night depository agreement(s), safe deposit box lease agreement, and any other such agreement(s) contained on the application or signature cards pertaining to any such services offered to the Titling Trust by such Bank, as amended from time to time;
(j) to sign and execute signature cards, applications and forms as any Bank will deem appropriate, from time to time, in connection with the opening and maintaining of Titling Trust Accounts at such Bank and/or obtaining any of the aforementioned additional related services; and
(k) to execute applications for the issuance of any savings or investment instrument in the name of the Titling Trust.

Without limiting the generality of Section 2.4, each of the Member and the Administrator is authorized to act on behalf of the Company (on its own behalf and on behalf of or with respect to each Series) and each Series and in the name of the Company (on its own behalf and on behalf of or with respect to each Series) or any Series, as the case may be:
(a) to establish bank accounts on behalf of and in the name of the Company (on its own behalf or on behalf of or with respect to each Series) (each, a “Company Account”);
(b) to sign checks, drafts, instruments, bills of exchange, acceptances and/or other orders for the payment of money from any Company Account;
(c) to endorse checks, instruments, evidences of indebtedness, and orders payable, owned or held by the Company (on its own behalf or on behalf of or with respect to each Series) or such Series;
(d) to accept drafts, acceptances, instruments and/or other evidences of indebtedness payable at or through the bank at which any Company Account is maintained (each, a “Bank”);
(e) to waive presentment, demand, protest and notice of protest or dishonor of any check(s), instrument(s), draft(s), acceptance(s), or other evidences of indebtedness made, drawn or endorsed by the Company (on its own behalf or on behalf of or with respect to each Series) or such Series;
(f) otherwise to deal with each Bank in connection with the foregoing activities on behalf of the Company (on its own behalf or on behalf of or with respect to each Series) or such Series;
(g) to enter into one or more agreements with the Bank, which will be deemed to govern the Company Accounts established at such Bank;
(h) to authorize the purchase, on behalf of the Company (on its own behalf or on behalf of or with respect to each Series) or such Series, short-term investments (e.g., certificates of deposit, money market funds and commercial paper) from each Bank;
(i) to obtain, on behalf of the Company (on its own behalf or on behalf of or with respect to each Series) or such Series, other related services from any Bank, such as the rental of safe deposit boxes from such Bank, obtaining of night depository services, routine cash management services, and the like, which will be governed by night depository agreement(s), safe deposit box lease agreement, and any other such agreement(s) contained on the application or signature cards pertaining to any such services offered to the Company (on its own behalf or on behalf of or with respect to each Serie...
Banking Activities. Each of the Facility Agent and the MLA's may accept deposits from, lend money to and generally engage in any kind of banking or other business with, any Group Member.
Banking Activities. I understand that you are not a bank and that you believe that providing the Valet Account does not constitute banking under the laws of any state. Final adverse rulings in any state that the Valet Account or certain features of the Valet Account constitute unauthorized banking therein or the adoption of legislation by any state affecting the Valet Account could force you to cease offering the Valet Account or certain features of the Valet Account in such state. If you determine such rulings or legislation require closure of my Securities Account, my Securities Account will be cancelled.
Banking Activities. Each of the Agent and the MLA may accept deposits from, lend money to and generally engage in any kind of banking or other business with, any RRL Group Company.
Banking Activities. Each of the Agent, the Arrangers and the Co-Arrangers may accept deposits from, lend money to and generally engage in any kind of banking or other business with, any Obligor, AngloGold, AngloGold (BVI) or any affiliate of any thereof.

(d) to accept drafts, acceptances, instruments and/or other evidences of indebtedness payable at or through the bank at which any such account is maintained (each, a “Bank”);
(e) to waive presentment, demand, protest and notice of protest or dishonor of any check(s), instrument(s), draft(s), acceptance(s), or other evidences of indebtedness made, drawn or endorsed by the Titling Trust;
(f) otherwise to deal with each Bank in connection with the foregoing activities on behalf of the Titling Trust;
(g) to enter into one or more agreements with any Bank, which will be deemed to govern the applicable account established at such Bank;
Banking Activities. RB Bancorp is a bank holding company authorized under the Bank Holding Company Act as such by the FRB. BRB is authorized by the Superintendent to conduct a general banking business and is not authorized to conduct a trust business. BRB is not a member of the Federal Reserve System. BRB's deposits are insured by the FDIC in the manner and to the full extent provided by law.
Banking Activities. FP Bancorp is a bank holding company authorized under the Bank Holding Company Act as such by the FRB. FPNB is authorized by the Comptroller to conduct a general banking business. FPNB is a member of the Federal Reserve System. FPNB's deposits are insured by the FDIC in the manner and to the full extent provided by law.
