Basic Rent and Additional Rent. 2.01. Tenant shall pay to Landlord Basic Rent over and above the other and additional payments to be made by Tenant.
2.02. Basic Rent shall be absolutely net to Landlord so that this Lease shall yield net to Landlord the Basic Rent throughout the Lease Term.
2.03. Tenant shall pay, as additional rent, all other amounts, liabilities, obligations and other payments which Tenant herein assumes or agrees to pay (collectively, "Additional Rent"), and, in the event of any failure on the part of Tenant to pay any item of Additional Rent, Landlord shall have all rights, powers and remedies provided for herein or by law in the case of nonpayment of Basic Rent.
2.04. Basic Rent and Additional Rent for the first month or partial month (calculated on the basis of the actual number of days of such partial month) of the Lease Term shall be paid to Landlord prior to the Commencement Date, and thereafter, payment shall be made on the first day of each month, without notice or demand, at the address specified by Landlord.
2.05. All payments of Basic Rent and Additional Rent shall be made without notice, demand, counterclaim, setoff, deduction or defense, and without abatement, suspension, deferment, diminution or reduction for any reason whatsoever, except as hereinafter otherwise specifically provided. Should any payment of Basic Rent or Additional Rent be received by Landlord subsequent to the 10th day of the month for which it is due, then Tenant shall pay to Landlord as Additional Rent, at that time, a late charge equal to two percent (2%) of the amount due under this Section.
2.06. On the Expiration Date or earlier termination of this Lease, Tenant shall remove its goods and effects and peacefully yield up the Premises to Landlord in the order and condition required by the provisions of Sections 10.01 and 10.
Basic Rent and Additional Rent. Rent to be paid under this Sublease shall include Basic Rent and Additional Rent as described in this Section 3, and all other sums that may be owing from Subtenant to Sublandlord under the terms of this Sublease.
Basic Rent and Additional Rent. Tenant covenants and agrees to pay to 453 Landlord all of the following (all of which is collectively referred to as “Rent”): 454 455 (a) Monthly basic rent (“Basic Rent”) in the sum of $55.00 for each Leased Space, to be 456 paid in advance on the first day of each month during the Term for the upcoming month or portion 457 thereof, provided that Rent for the last calendar month of the Term or portion thereof shall be due and 458 payable on the last day of the Term. 459 460 (b) Additional rent (“Additional Rent”) in the amount of any payment referred to as 461 such in any portion of this Lease that accrues while this Lease is in effect, which shall include any and all 462 charges or other amounts that Tenant is obligated to pay Landlord under this Lease other than Basic Rent. 463 464 (c) This Section 4.1 is subject to Section 4.5(b). 465
Basic Rent and Additional Rent. Tenant shall pay to Landlord all Basic Rent and (to the extent payable to Landlord) Additional Rent by wire transfer of federal funds or collected funds immediately available to Landlord on the dates when rent is due as provided in Section 4(b) hereof, at Landlord’s address set forth above, or at such other place in the continental United States as Landlord may from time to time designate.
Basic Rent and Additional Rent. (a) Starting on the first day of the thirteenth month from the Commencement Date and continuing through the fifth year following said date, Tenant shall pay as basic rent ("Basic Rent") the annual sum of TWO HUNDRED SIXTY-TWO THOUSAND EIGHT HUNDRED THIRTY-SEVEN AND 50/100 ($262,837.50) DOLLARS or $21.50 per square foot of rental space in equal monthly installments of TWENTY-ONE THOUSAND NINE HUNDRED THREE AND 13/100 DOLLARS ($21,903.13) on or before the first date of each month, in advance, to Landlord at the address of the Landlord above designated or such other place as shall be designated by Landlord. Landlord agrees to waive basic rental payments (with the exception of tenant electric) for the initial twelve (12) months of the lease term.
(b) As additional consideration to the Tenant for the Tenant's entry into this lease transaction, and upon the condition that the Tenant is not in default of this Agreement of Lease, the Landlord shall pay to the Tenant the sum of $8,000. on August 1, 1988 and a similar sum on September 1, 1988, but such payment shall not be required at any other times.
(c) Tenant shall also pay as Additional Rent any and all such other sums of money as shall become due to the Landlord pursuant to the terms and provisions hereof including but not limited to Tenant improvements authorized by and to be paid by Tenant, without demand therefor and without any abatement, counterclaim, deduction or setoff whatsoever except as provided herein. Basic Rent and Additional Rent is sometimes hereinafter collectively referred to as "Rent".
(d) If Tenant shall fail to pay the Basic Rent and Additional Rent within ten (10) business days following the due date of any such payment, and if Landlord agrees to accept any such late payment, then in the event of such late payment, the Tenant agrees to pay to Landlord interest on any such sums at the rate of 5% of any such late installment of Rent or Additional Rent, as Additional Rent, or if said rate under the circumstances then prevailing shall not be lawful, then at the maximum lawful rate permitted. The foregoing shall be in addition to any other right or remedy which may be available to Landlord in the event of default by Tenant.
(e) The Tenant agrees to deposit with the Landlord upon the execution date of this Lease the sum of $21,903.13 as security for the payment of Rent and/or Additional Rent hereunder and the full and faithful performance by the Tenant of the covenants and conditions on the part ...
Basic Rent and Additional Rent. The Subtenant covenants to pay as basic rent (“Sublease Basic Rent”) for the whole period of the Sublease Term commencing on April 1, 2005 and ending on April 1, 2006 the sum of $12,000 per annum, in equal monthly instalments payable in advance on the first day of each and every month. The Subtenant covenants to pay all Additional Rent when due under the Head Lease. The Sublease Basic Rent and Additional Rent will be referred to collectively as “Rent”.
Basic Rent and Additional Rent. 2.01 Tenant shall pay to Landlord a net monthly rental (herein called Basic Rent), over and above the other and additional payments to be made by Tenant, in the amount specified in ITEM 6 OF THE TERM SHEET.
2.02 Basic Rent for the first month or partial month (calculated on the basis of the actual number of days of such partial month of the Lease Term) shall be paid to Landlord on or before the Commencement Date and thereafter each installment of Basic Rent shall be paid on or before the first business day of each and every calendar month during the Lease Term. Basic Rent and Additional Rent. Tenant covenants and agrees to pay to Landlord all of the following (all of which is collectively referred to as “Rent”): (a) Monthly basic rent (“Basic Rent”) in the sum of FORTY-FIVE Dollars ($45.00) for the first 10 years of the Term and FIFTY-FIVE Dollars ($55.00) for the last 10 years of the Term for each Leased Space, to be paid in advance on the first day of each month during the Term for the upcoming month or portion thereof, provided that Rent for the last calendar month of the Term or portion thereof shall be due and payable on the last day of the Term.
Basic Rent and Additional Rent. The Parties agree that Section 3(a) ------------------------------ of the Ground Lease is hereby amended to delete the phrase "180 days" and to replace it with the phrase "270 days." Except as modified by this Amendment, the Ground Lease shall remain in full force and effect. In the event of any conflict between the terms of the Ground Lease and the terms of this Amendment, the terms of this Amendment shall control.
Basic Rent and Additional Rent. Basic Rent and Additional Rent for the First Expansion Premises and the Additional Expansion Premises shall be payable at the same rates and in the same manner as the same are due and payable with respect to the Premises. A schedule of Basic Rent for the period from commencement of the First Expansion Premises to the Lease expiration is attached as Exhibit "B". Tenant's Allocated Share shall be adjusted as of the respective dates of commencement to incorporate the First Expansion Premises and the Additional Expansion Premises into the Premises, all as set forth on Exhibit "B".
