BENEFICIARY’S RIGHTS. If the RTC fails to abide by the terms of this Participation Agreement, and DHA or its designee either denies the claim or claims and/or terminates the agreement as a result, the RTC agrees to forego its rights, if any, to pursue the amounts not paid by TRICARE from the beneficiary or the beneficiary’s family. BENEFICIARY’S RIGHTS. The Pledgor agrees that the rights acquired by the Beneficiary in accordance with this Agreement shall not be interrupted or harmed by him or any of his heirs or representatives through any legal proceedings.
BENEFICIARY’S RIGHTS. The Guarantor authorizes the Beneficiary, without notice or demand and without affecting the Guarantor’s liability hereunder, to take and hold security from any other Person for the payment of this Guarantee and/or any of the Guaranteed Obligations, and exchange, enforce, waive and release any such security; to apply such security and direct the order or manner of sale thereof, as the Beneficiary, in its sole discretion, may determine; and to obtain a guarantee of the Guaranteed Obligations from any one or more Persons and at any time or times to enforce, waive, rearrange, modify, limit or release any of such other Persons from their obligations under such guaranties.
BENEFICIARY’S RIGHTS. Contractor shall inform Medi-Cal Beneficiaries of their following rights: • Beneficiary grievance, appeal, and fair hearing procedures and timeframes as specified in 42 CFR 438.400 through 42 CFR 438.424. • The beneficiary’s right to file grievances and appeals and the requirements and timeframes for filing. • The availability of assistance to the beneficiary with filing grievances and appeals. • The beneficiary’s right to request a State fair hearing after Contractor has made a determination on an enrollee's appeal, which is adverse to the beneficiary. • The beneficiary’s right to request continuation of benefits that Contractor seeks to reduce or terminate during an appeal or state fair hearing filing, if filed within the allowable timeframes, although the beneficiary may be liable for the cost of any continued benefits while the appeal or state fair hearing is pending if the final decision is adverse to the beneficiary.
