Binding Corporate Rules. If Supplier processes SFDC Customer Data, then Supplier acknowledges that SFDC has obtained approval of the Salesforce Processor Binding Corporate Rules (“BCR”), which is included as a legal transfer mechanism in the agreement with its Customers to cover any transfer of Personal Data outside of the European Union, the European Economic Area, their European Union’s member states, or Switzerland. Supplier agrees that it shall abide by the relevant terms of the BCR, as updated from time to time, and as published at xxxx://xxx.xxxxxxxxxx.xxx/assets/pdf/misc/Salesforce-Processor-BCR.pdf, regarding such Personal Data.

Binding Corporate Rules. In case the Supplier or Sub-Processor, as relevant, has in place binding corporate rules, it confirms that all of the Processing of Agreement Personal Data is covered by the Supplier's or Sub-Processor's binding corporate rules, the terms of which are incorporated into these terms. The Supplier agrees that PPG, as data controller, has the right to enforce these binding corporate rules against the Supplier or Sub-Processor, as relevant, including a right to compensation in the event that the rules are breached.
