Buyer’s Environmental Reports. Buyer may, at its sole cost and expense, hire qualified environmental consultants reasonably acceptable to Seller to make environmental assessments of the Assets. Buyer’s right to conduct such an environmental assessment of the Assets is conditioned upon the following:
Buyer’s Environmental Reports. Promptly after Buyer's receipt thereof, Buyer shall deliver to the Company copies of all environmental reports prepared for Buyer with respect to the Owned Real Property or the Leased Real Property, as listed in Section 4.20 of the Company Disclosure Letter.

Xxxxx acknowledges that it is aware of and familiar with the provisions of Section 1542 of the California Civil Code which provides as follows: “A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.” Until the exchange of title, Buyer shall, upon learning of any fact or condition which would cause any of the warranties and representations in this Section not to be true or any material change in the condition of the Site, immediately give Notice of such fact or condition to City, and City shall have the right to approve or disapprove such fact or condition, and upon any such disapproval, terminate this Agreement.
